HomeMy WebLinkAboutOrdinance 17632-07-2007Ordinance No. 17632-07-2007 AN ORDINANCE INCREASING APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $44,545 AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING THE FAIR EMPLOYMENT PRACTICES PROGRAM AND ONE CENTRAL CITY COORDINATOR POSITION FROM THE GRANTS FUND TO THE GENERAL FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased appropriations in the General Fund in the amount of $44,545 and decreasing the unreserved, undesignated fund balance by the same amount, for the purpose of transferring the Fair Employment Practices Program and one Central City Coordinator position from the Grants Fund to the General Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached supplemental appropriation ordinance increasing appropriations in the General Fund by $44,545 and decreasing the unreserved, undesignated General Fund balance by the same amount; 2. Transfer the Central City Coordinator position from the Community Development Block Grant (CDBG) Project in the Grants Fund to the General Fund; and 3. Transfer the Fair Employment Practices Program from the Grants Fund to General Fund. DISCUSSION: Central City Coordinator: To realize the City's strategic goal of revitalization of central city neighborhoods and the Comprehensive Plan goal of having an active neighborhood association in every residential part of Fort Worth, the Community Relations Department has a public education specialist devoted to neighborhood capacity building in Community Development Block Grant (CDBG) eligible areas. CDBG funds currently provide for 70 percent of the salary and benefits of this public education specialist. Services provided by this position include, community building through the development of relationships with underserved communities and hard to reach populations and capacity building through technological and educational assistance, assistance with accessing city services, and assistance with organizational development. The public education specialist also provides fair housing outreach, Spanish translation services for community meetings, task forces and public forums and assists in maintaining the neighborhood database, the neighborhood website, the neighborhood organizational meeting calendar and the neighborhood email subscriber list. The appropriation of $8,179 would fund the 30 percent gap currently existing in this program. Fair Employment Practices Program: In 1975, the City adopted an ordinance prohibiting employment discrimination and in 1976 the City became certified by the U.S. Equal Opportunity Commission (EEOC) as a .Fair Employment Practices Agency (FEPA). Since 1976, the EEOC has provided funding to the City for the City's fair employment practices program. The Community Relations Department (CRD) is responsible for enforcement of the City's anti-discrimination ordinances. The department will resolve 187 jurisdictional cases through the facilitated resolution process or Logname: 03SUPPAPPROP Page 1 of 2 through investigation. Under the terms of the current work-sharing agreement between the City and EEOC, the EEOC provides training and technology. The EEOC also pays the Community Relations Department $550 for each dual- filed charge of employment discrimination resolved by the Department. This $550 payment per case is insufficient to cover rising personnel and administrative costs. This appropriation of $36,366 would transfer two existing authorized positions from the U.S. Equal Employment Opportunity Commission Grant (EEOC) to general fund and cover the supplies and contractual service costs of personnel assigned to resolve employment discrimination complaints. General fund program costs will be partially offset by EEOC contract payments. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the General Fund. Upon approval, the unaudited, unreserved fund balance of the General Fund will be $5,583,933, which is the amount available above the minimum reserve fund balance of $46,845,951 required by the City's Financial Management Policy Statements (i.e., 10 percent of the current- year adopted budget expenditures less the annual transfer from the General Fund to the Debt Service Fund).
