The subject right-of-way, acquired by dedication, is neither open nor paved
and contains sewer, electric and gas facilities. The agencies responsible
e; for these public facilities request the vacated right-of-way be retained as
a utility easement.
The reviewing City departments and private utility companies have no object-
ions to this request provided:
1. The vacated right-of-way is retained as a utility easement;
2. The vacated right-of-way is replatted with abutting property;
3. Public ingress-egress is provided for that portion of the alley remaining
open.
The City Plan Commission has reviewed this request and recommends that an
ordinance be adopted vacating subject right-of-way as requested. A satis-
factory replat has been submitted to the City Staff with all three require-
ments listed above taken care of.
Recommendation
It is recommended that an ordinance be adopted vacating subject right-of-way
as recommended by the City Plan Commission.
