AN ORDINANCE PROVIDING THAT SOUTH MAIN STREET FROM MORNINGSIDE DRIVE SOUTH TO CAPPS STREET AND ADJACENT TO LOTS "A" AND 9, KRULL PLACE ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND THE MISSOURI- KANSAS-TEXAS RAILROAD COMPANY RIGHT-OF-WAY BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That South Main Street from Morningside Drive south to Capps Street, being adjacent to Lots "A" and 9, Krull Place Addition to the City of Fort Worth, Tarrant County, Texas, and the Missouri-Kansas-Texas Railroad Company right-of-way, be and the same is hereby closed, abandoned and permanently va- cated as a street or public thoroughfare of any kind or char- acter whatever, save and except that easements are reserved for any and all existing utilities. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. APP WE S TO ORM AND LEGALI ity Attorney FoLe DIMES LINE KIMBRQ City of Dort Worth, texas BAILIFF PAIGE Mayor and Council Communication ORANAM REED HUMAN ROBINS PRATE REFERENCE SUBJECT: Street Vacation - 2600 Block PAGE NUMBER South Main Street (V-75-25) DAVIS OANTE RE 11/3/75 PZ-701 1 Of 1 WALLS WRAM Broyles and Broyles, Inc. , owner of Lots A and 9, Krull Place Addition, with the consent of Missouri-Kansas--Texas Railroad Company, owners of all LIM abutting property, has requested that the City vacate South Main Street in the 2600 block a width of 60 feet at the north end and a variable width at the south end and a length of approximately 268 feet from Morningside Drive south to Capps Street adjacent to Lots A and 9, Krull Place Addition, and the Missouri-Kansas-Texas right-of-way, as shown on the attached map. Subject right-of-way, acquired by dedication, is partially open (from Capps Street northward to just south of Morningside Drive) and paved, and contains water, sewer, gas, telephone and electric facilities. Reviewing City Depart- ments and private utility companies have no objections to this request provided: 1. The vacated right-of-way is replatted with abutting property; 2. The entire vacated right-of-way is retained as a utility easement; 3. The vacated right-of-way is physically closed with standard curb and gutter at Capps Street. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject right-of-way as requested. A satis- factory replat has been submitted to City staff and arrangements have been made to physically close the street with curb and gutter at Capps Street. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as requested by the City Plan Commission.
