HomeMy WebLinkAboutOrdinance 7353 ORDINANCE NO. 3, AN ORDINANCE VACATING, ABANDONING AND CLOSING THAT PORTION OF THE ALLEY IN BLOCK 58, RYAN SOUTHEAST ADDITION, ABUTTING LOTS 1 THROUGH 36, FROM NEW PORK AVENUE EAST TO MISSISSIPPI AVENUE, RETAINING EASE- MENTS THEREIN FOR EXISTING FACILITIES; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the portion of the alley in Block 58, Ryan Southeast Addition, abutting Lots 1 through 36, from New York Avenue East to Mississippi Avenue be and the same is hereby vacated, abandoned and permanently closed as an alley, SAVE AND EXCEPT that in said vacated right-of-way be and the same is hereby retained a utility easement for any and all existing utilities. SECTION 2. That the fee to the land in the above described vacated alley is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved therein for any and all existing and prospective utilities, as indicated. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. City Attorney FILE �, wIMQt City of Dort Worth, Texas BAILIFF �AIFF Mayor and Council Communication NUMAN ROBIN DATE REFERENCE SUBJECT: Alley Vacation: Block 58, PAGE DiAVW SANTEI IRE NUMBER Ryan Southeast Addition (V-73-34) 1 5/17/76 PZ-738 for W�Cktd The Director of Public Works, with the consent of all abutting property owners, has requested that the City vacate the alley in Block 58, Ryan Southeast Addition, abutting Lots 1 through 36, from New York Avenue east to Mississippi Avenue. The subject right-of-way, acquired by dedication, is open but unimproved. There are existing utility facilities located therein. Reviewing City departments and private utility companies have reviewed this request and have no objections provided easements are retained where necessary for existing facilities. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject right-of-way as requested. A satis- factory replat has been submitted to the City staff for the east 150 feet of the alley. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission.
