HomeMy WebLinkAboutOrdinance 6858ORDINANCE NO. t ,%_ AN ORDINANCE PROVIDING THAT FOREST CREST DRIVE FROM HIDDEN ROAD TO THE WEST LINE OF LOT 5, PEBBLE CREEK ADDITION, A SUBDIVISION OF BLOCK 24, RIVERCREST ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE VACATED, ABAN- DONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Forest Crest Drive from Hidden Road to the west line of Lot 5, Pebble Creek Addition, a subdivision of Block 24, Rivercrest Addition to the City of Fort worth, Tarrant County, Texas, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever, save and except that easements are reserved for any and all existing utilities. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Thompson, w,id the consent of all other owners in Pebble Creek OIL11�1 Addition, has requested that the City vacate Forest Crest Drive as a public street from Hid4�, Road to the west line of Lot 5, Pebble Creek Addition, as shown on :X attached map. This public right -of -way, located between the north line of Pebble Creek Addition and the River Crest Country Club, extends a distance of more than 700 feet to a dead -end, with no dedicated turn - around. Acquired by dedication, it is unimproved. The Fire Department has stated that access to Lots 2, 3B, 4 & 5 must be retained and kept open for emergency vehicle use to provide service to the interior of the addition. The Police Department has concurred with this comment. Collinear utility easements should also be retained in the appropriate locations. The reviewing City departments and public utility companies have no objections to this request provided the Applicants replat the vacated right-of-way with adjoining property, retaining the northern 15 feet portion which abuts the existing 15 feet easement on River Crest Country Club property as an emergency access easement, providing pro- vision for turn - around at the northern end of Hidden Road and dedicating collinear easements for water and sewer lines and providing other utility easements as needed. A satisfactory replat has been received by the City staff. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right -of -way as requested. Recommendation It is recommended that an ordinance be adopted vacating the subject right -of -way as recommended by the City Plan Commission.
