AN ORDINANCE PROVIDING FOR THE SUBMISSION TO
THE RESIDENT QUALIFIED ELECTORS OF THE CITY r
OF FORT WORTH, TEXAS, OF PROPOSITIONS FOR
THE ISSUANCE OF NEGOTIABLE COUPON BONDS OF
SAID CITY IN THE AGGREGATE SUM OF ONE HUNDRED
THIRTY-SIX MILLION FIVE HUNDRED THOUSAND
DOLLARS ($136,500,000.00) FOR THE PURPOSE
OF MAKING PERMANENT CITY IMPROVEMENTS BY CON-
STRUCTING, IMPROVING AND EXTENDING THE STREETS,
THOROUGHFARES AND STORM DRAINS OF SAID CITY AND
ACQUIRING THE NECESSARY LANDS THEREFOR; FOR THE
PURPOSE OF MAKING PERMANENT CITY IMPROVEMENTS
BY CONSTRUCTING, BUILDING AND EQUIPPING CITY FIRE
STATIONS AND TRAINING AND MAINTENANCE FACILITIES,
IMPROVING AND EXTENDING THE CITY FIRE ALARM AND
COMMUNICATIONS SYSTEM AND ACQUIRING THE NECESSARY
LANDS THEREFOR; FOR THE PURPOSE OF MAKING PERMA-
NENT CITY IMPROVEMENTS BY PURCHASING, ACQUIRING,
CONSTRUCTING, RECONSTRUCTING, EQUIPPING AND IM-
PROVING THE PLAYGROUNDS, BOTANIC GARDENS, GREEN-
HOUSES, CONSERVATORIES, RECREATION PARKS AND
RECREATION, NATURE REFUGE, AND ZOOLOGICAL PARK
FACILITIES OF SAID CITY AND ACQUIRING THE
NECESSARY LANDS THEREFOR; FOR THE PURPOSE OF
MAKING PERMANENT CITY IMPROVEMENTS BY ESTABLISH-
ING, DEVELOPING, CONSTRUCTING, ENLARGING, IMPROV-
ING AND EQUIPPING ITS AIRPORTS AND AIR NAVIGATION
FACILITIES, INCLUDING BUILDINGS AND OTHER FACILITIES
INCIDENT TO THE OPERATION THEREOF, AND THE ACQUISI-
TION OR ELIMINATION OF AIRPORT HAZARDS, AND ACQUIR-
ING THE NECESSARY LANDS THEREFOR; FOR THE PURPOSE
OF MAKING PERMANENT CITY IMPROVEMENTS BY CONSTRUCT-
ING, RECONSTRUCTING, EQUIPPING, REMODELING AND
IMPROVING THE WILL ROGERS MEMORIAL COLISEUM AND
FACILITIES THEREOF; AND A PROPOSITION FOR THE PUR-
POSE OF DETERMINING UPON THE ISSUANCE OF REVENUE
BONDS IN THE SUM OF TWENTY-FOUR MILLION DOLLARS
($24,000,000.00) FOR THE PURPOSE OF MAKING PER-
MANENT CITY IMPROVEMENTS BY IMPROVING, EXTENDING
AND ENLARGING THE SANITARY SEWER SYSTEM AND
SEWAGE DISPOSAL PLANTS OF SAID CITY AND ACQUIRING
THE NECESSARY LANDS THEREFOR; AND A PROPOSITION
FOR THE PURPOSE OF DETERMINING UPON THE ISSUANCE
OF REVENUE BONDS IN THE SUM OF TWENTY MILLION
DOLLARS ($20,000,000.00) IN ADDITION TO SEVENTY-
EIGHT MILLION NINE HUNDRED FIFTY THOUSAND DOLLARS
($78,950,000.00) WORTH OF SAID BONDS HERETOFORE
AUTHORIZED, FOR THE PURPOSE OF MAKING PERMANENT
CITY IMPROVEMENTS BY IMPROVING AND EXTENDING THE
WATER WORKS SYSTEM OF SAID CITY, SAID BONDS TO BE
ISSUED AT ONE TIME OR IN INSTALLMENTS FROM TIME TO
TIME AS THE CITY COUNCIL SHALL DETERMINE, THE BONDS
OF EACH INSTALLMENT BEING PAYABLE SERIALLY AS MAY
BE DETERMINED BY THE CITY COUNCIL SO THAT THE LAST
MATURING BONDS SHALL BECOME PAYABLE WITHIN FORTY
(40) YEARS FROM THE DATE THEREOF, AND BEARING IN-
TEREST AT A RATE NOT TO EXCEED THE MAXIMUM PRE-
SCRIBED BY LAW AT THE TIME OF THE ISSUANCE THEREOF,
PAYABLE SEMI-ANNUALLY, AND PROVIDING FOR THE PAY-
MENT OF PRINCIPAL AND INTEREST ON SAID BONDS BY
PLEDGING THE COMBINED NET REVENUES FROM THE OPER-
ATION OF THE WATER AND SEWER SYSTEM OF SAID CITY;
FOR THE PURPOSE OF MAKING PERMANENT CITY IMPROVE-
MENTS BY CONSTRUCTING, BUILDING AND EQUIPPING
CITY POLICE STATIONS, ADMINISTRATIVE OFFICES,
VEHICLE PARKING FACILITIES, TRAINING FACILITIES,
PRISONER DETENTION FACILITIES, AND COURTROOM
FACILITIES AND ACQUIRING THE NECESSARY LANDS
THEREFOR; AND A PROPOSITION FOR THE PURPOSE OF
DETERMINING UPON THE ISSUANCE OF BONDS FOR THE
MUNICIPAL PURPOSE OF ACQUIRING, CONSTRUCTING,
EQUIPPING AND IMPROVING THE PHYSICAL EQUIPMENT,
FACILITIES AND PERSONAL PROPERTY OF A PUBLIC
TRANSPORTATION SYSTEM AND ACQUIRING THE NECES-
SARY LANDS THEREFOR; PROVIDING THAT SAID ELECTION
BE HELD IN CERTAIN PLACES AND APPOINTING PRE-
SIDING JUDGES FOR EACH PRECINCT; PROVIDING FOR
ABSENTEE VOTING; PROVIDING FOR THE USE OF VOTING
MACHINES AND PRESCRIBING OFFICIAL BALLOTS THERE-
FOR; ORDERING AND DIRECTING THE CITY SECRETARY
TO PREPARE AND ISSUE OFFICIAL BALLOTS FOR ABSENTEE
VOTING AND OFFICIAL BALLOTS FOR VOTING MACHINES,
AND REQUIRING THAT THIS ORDINANCE BE PRINTED IN
THE ENGLISH AND SPANISH LANGUAGES; PROVIDING THAT
WATERWORKS SYSTEM REVENUE BONDS VOTED ON SHALL
NOT BE PAID FOR BY TAXATION; RESERVING THE RIGHT
TO ISSUE WATERWORKS SYSTEM REVENUE BONDS AND TAX-
SUPPORTED BONDS IN INSTALLMENTS; AUTHORIZING THE
CITY COUNCIL TO ISSUE TAX-SUPPORTED AND REVENUE
BONDS IN SUCH DENOMINATIONS AS IT MAY DETERMINE
AND REQUIRING THAT SAME MATURE WITHIN FORTY (40)
YEARS FROM THE DATE THEREOF AT RATES NOT TO EX-
CEED THE MAXIMUM PRESCRIBED BY LAW AT THE TIME
OF THE ISSUANCE THEREOF, PAYABLE SEMI-ANNUALLY,
EXPRESSED IN COUPON NOTES ATTACHED TO THE BONDS;
LEVYING A SUFFICIENT TAX TO PAY THE INTEREST ON
THE GENERAL OBLIGATION BONDS AT THE MATURITY
THEREOF; AND CALLING A SPECIAL ELECTION TO BE
HELD IN THE CITY OF FORT WORTH, TEXAS, ON TUESDAY,
THE 7TH DAY OF FEBRUARY, 1978.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That a special election be held in the City of Fort Worth,
Texas, on Tuesday, the 7th day of February, A. D. 1978, at the

polling places hereinafter described, between the hours of
7:00 A.M., and 7:00 P.M., at which election the following
propositions for the issuance of bonds of the City of Fort
Worth, Texas, each and all of which propositions contain a
purpose clause which has been found and determined by the
City Council to be a permanent, public improvement and for
a legitimate municipal purpose, shall be submitted to the
resident, qualified electors of said City:
PROPOSITIONS
1.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Fifty-six Million Three Hundred Fifty Thousand and
NO/100 Dollars ($56,350,000.00) for the purpose of making
permanent city improvements by constructing, improving and
extending the streets, thoroughfares and storm drains of said
city, including in such permanent public improvements the
straightening, widening, paving, grade separation, lighting
and drainage of said streets and thoroughfares, and acquiring
the necessary lands therefor, said bonds being payable serially
as may be determined by the City Council, so that the last
maturing bonds shall become payable within forty (40) years
from the date thereof, bearing interest at a rate not to ex-
ceed the maximum prescribed by law at the time of the issuance
thereof, payable semi-annually, and levy a sufficient tax to
pay the interest on said bonds and create a sinking fund suf-
ficient to redeem said bonds at the maturity thereof?

2.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Four Million Seven Hundred Fifty Thousand and No/100
Dollars ($4,750,000.00) for the purpose of making permanent
city improvements by constructing, building and equipping
city fire stations and training and maintenance facilities,
improving and extending the city fire alarm and communications
system and acquiring the necessary lands therefor, said bonds
being payable serially as may be determined by the City Council
so that the last maturing bonds shall become payable within
forty (40) years from the date thereof, bearing interest at a
rate not to exceed the maximum prescribed by law at the time
of the issuance thereof, payable semi-annually, and levy a
sufficient tax to pay the interest on said bonds and create a
sinking fund sufficient to redeem said bonds at the maturity
thereof?
3.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Thirteen Million Seven Hundred Thousand and N0/100
Dollars ($13,700,000.00) for the purpose of making permanent
city improvements by purchasing, acquiring, constructing, re-
constructing, equipping and improving the playgrounds, parks,
botanic gardens, greenhouses, conservatories, nature refuge,
recreation, and zoological park facilities of said city and
acquiring the necessary lands therefor, said bonds being pay-
able serially as may be determined by the City Council, so

that the last maturing bonds shall become payable within forty
(40) years from the date thereof, bearing interest at a rate
not to exceed the maximum prescribed by law at the time of the
issuance thereof, payable semi-annually, and levy a sufficient
tax to pay the interest on said bonds and create a sinking
fund sufficient to redeem said bonds at the maturity thereof?
4.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of one Million Eight Hundred Thousand and N0/100 Dollars
($1,800,000.00) for the purpose of making permanent city
improvements by establishing, developing, constructing, en-
larging, improving and equipping its airports and air navigation
facilities, including buildings and other facilities incident
to the operation thereof and the acquisition or elimination of
airport hazards, and acquiring the necessary lands therefor,
said bonds being payable serially as may be determined by the
City Council, so that the last maturing bonds shall become pay-
able within forty (40) years from the date thereof, bearing
interest at a rate not to exceed the maximum prescribed by law
at the time of the issuance thereof, payable semi-annually,
and levy a sufficient tax to pay the interest on said bonds and
create a sinking fund sufficient to redeem said bonds at the
maturity thereof?
5.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal

sum of One Million Two Hundred Thousand and N0/100 Dollars
($1,200,000.00) for the purpose of making permanent city im-
provements by constructing, reconstructing, equipping, re-
modeling and improving the Will Rogers Memorial Coliseum and
facilities thereof, said bonds being payable serially as may
be determined by the City Council, so that the last maturing
bonds shall become payable within forty (40) years from the
date thereof, bearing interest at a rate not to exceed the
maximum prescribed by law at the time of the issuance thereof,
payable semi-annually, and levy a sufficient tax to pay the
interest on said bonds and create a sinking fund sufficient
to redeem said bonds at the maturity thereof?
6.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Twenty-four Million and N0/100 Dollars ($24,000,000.00)
for the purpose of making permanent city improvements by im-
proving, extending and enlarging the sanitary sewer system
and sewage disposal plants of said city and acquiring the
necessary lands therefor, said bonds to be issued at one time
or in installments from time to time as the City Council shall
determine, the bonds of each installment being payable serially
as may be determined by the City Council, so that the last
maturing bonds shall become payable within forty (40) years
from the date thereof, bearing interest at a rate not to
exceed the maximum prescribed by law at the time of the
issuance thereof, payable semi-annually, and providing for
the payment of principal and interest on said bonds by pledging
the combined net revenues from the operation of the Water and
Sewer Systems of said City?

7.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Twenty Million and N01100 Dollars ($20,000,000.00)
in addition to bonds in the aggregate principal amount of
Seventy-eight Million Nine Hundred Fifty Thousand Dollars
($78,950,000.00) heretofore authorized by the City pursuant
to propositions adopted by a majority vote of the qualified
electors of the City at special elections held on January 25,
1949, January 26, 1954, January 31, 1956, October 19, 1965
and December 9, 1975, respectively, for the purpose of
making permanent city improvements by improving and extending
the Waterworks System of said city, said bonds to be issued
at one time or in installments from time to time as the City
Council shall determine, the bonds of each installment being
payable serially as may be determined by the City Council, so
that the last maturing bonds shall become payable within forty
(40) years from the date thereof, and bearing interest at a
rate not to exceed the maximum prescribed by law at the time
of the issuance thereof, payable semi-annually, and providing
for the payment of principal and interest on said bonds by
pledging the combined net revenues from the operation of the
Water and Sewer Systems of said City?
8.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal

sum of Fourteen Million and No/100 Dollars ($14,000,000.00)
for the purpose of making permanent city improvements by
constructing, building and equipping city police stations,
administrative offices, vehicular parking facilities, training
facilities, prisoner detention facilities, and courtroom fa-
cilities and acquiring the necessary lands therefor, said bonds
being payable serially as may be determined by the City Council,
so that the last maturing bonds shall become payable within
forty (40) years from the date thereof, bearing interest at a
rate not to exceed the maximum prescribed by law at the time
of the issuance thereof, payable semi-annually, and levy a
sufficient tax to pay the interest on said bonds and create
a sinking fund sufficient to redeem said bonds at the maturity
thereof?
9.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Seven Hundred Thousand and No/100 Dollars ($700,000.00)
for the legitimate municipal purpose of acquiring, constructing,
equipping and improving the physical equipment, facilities and
personal property of a public transportation system, and ac-
quiring the necessary lands therefor, said bonds being payable
serially as may be determined by the City Council, so that
the last maturing bonds shall become payable within forty (40)
years from the date thereof, bearing interest at a rate not
to exceed the maximum prescribed by law at the time of the

issuance thereof, payable semi-annually, and levy a sufficient
tax to pay the interest on said bonds and create a sinking fund
sufficient to redeem said bonds at the maturity thereof?

SECTION III.
That said election shall be held under the provisions
of the Charter of the City of Fort Worth, Texas, and the
Constitution and laws of the State of Texas and the United
States of America insofar as same may be applicable, and
all resident, qualified electors shall be allowed to vote
upon said propositions, and all of such electors shall vote
in the election precinct of their residence or as provided
by law.
SECTION IV.
That absentee voting shall be on paper ballots and
such ballots shall conform to the requirements of Article
6.06 of the Election Code of the State of Texas, as amended,
which provides that a square shall be placed beside the
proposition, in which the voter is requested to place an
"X" or other clear mark to indicate the way he wishes to
vote, but which also provides that the failure of a voter
to mark his ballot in strict conformity with the instruc-
tions on the ballot shall not invalidate the ballot, and
the ballot shall be counted if the intention of the voter
is clearly ascertainable, except where the law expressly
prohibits the counting of the ballot.
Election materials shall be made available in English
and Spanish at every polling place within the city as re-
quired under the provisions of Article 1.08a of the Election
Code of the State of Texas, as amended. Absentee voting

materials shall be printed in both English and Spanish. Such
requirements apply to (a) forms for applying for an absentee
ballot, (b) the ballot envelopes and carrier envelopes and
(c) any other instructions or forms furnished to the voters.
Such instructions and forms shall be printed with both English
and Spanish translations on the face of the instrument or may
be furnished separately along with each instrument. All
absentee ballots and ballot labels shall comply with the re-
quirements applicable to other ballots and ballot labels.
Whenever the Spanish translation of the ballot proposition
is printed separately from the ballot, a copy of the trans-
lation shall be furnished to each voter who votes by mail.
The conduct of absentee voting by personal appearance shall
comply with the requirements set forth in Article 1.08a of
the Election Code of the State of Texas, as amended.
It is specifically provided that the election officers
shall not refuse to count a ballot because of a voter having
marked his ballot by scratching out the statement or proposition
(either in English or Spanish) for which he does not wish to
vote.

That voting machines approved by the Commissioners' Court

SECTION VII.
That the City Secretary is hereby ordered and directed
to prepare and issue ballots for absentee voting and for
voting machines and to stamp same "Official Ballot," on which
ballots shall be printed in both English and Spanish the
propositions hereinabove set forth.
SECTION VIII.
That in the event the tax-supported and/or revenue bonds
are authorized at the special election hereby ordered, the
City Council of the City of Fort Worth, Texas, may issue for
sale any part or portion of said amounts at such time and times
as in the judgment of the City Council it determines that a
lawful interest and sinking fund may be provided for to take
care of and discharge any part or portion of the bonds so is-
sued for sale, it being the purpose of this section to make
clear that the City Council of the City of Fort Worth, Texas,
may not be required to issue the full amount of the series
of bonds as herein submitted but may issue for sale any portion
of the same at such time and times as it determines advisable,
under the authority hereby conferred after said election.
SECTION IX.
That all of the bonds herein authorized to be issued by
the electorate shall be in such denominations as may be de-
termined by the City Council and shall mature serially in the
regular order in which they are numbered, making the last
bonds mature within forty (40) years from the date thereof,
unless the City Council, in the exercise of its discretion,

shall otherwise provide for such maturity; and said bonds
shall be sold at not less than par and shall bear interest
at rates per annum not to exceed the rates prescribed by
law at the time of their issuance, and shall be payable
semi-annually.
SECTION X.
That the City Secretary shall furnish to the election
officials said ballots and voting machines, together with
any other forms, blanks or instructions in accordance with
the Charter of the City of Fort Worth, Texas, and the laws
of the State of Texas insofar as same are applicable, and
the provisions of this ordinance.
SECTION XI.
That the way and manner of holding this election, the
notice to be given therefor, the polling places, the per-
sonnel of the officers, precinct judges and substitutes
therefor who are to hold the same, and all details connected
with the holding of the election shall be determined and
arranged by the City Council and administered under the dir-
ection of and by the City Secretary.
SECTION XII.
That this ordinance shall be printed in English and
Spanish and shall constitute the election order for such
special election. A substantial copy of each printing shall
serve as the notice of election under the Laws of the State
of Texas.

SECTION XIII.
That the City Secretary is hereby authorized and directed
to cause notice of said election to be given by posting sub-
stantial copies of this election order, printed in English and
Spanish, in each of the election precincts of said City and also
at the City Hall. That these notices of said election shall also
be published on the same day in each of two (2) successive weeks
in a newspaper of general circulation published within said City,
the date of the first publication to be not less than fourteen
(14) days prior to the date set for said election; and the City
Secretary shall see that proper publication is made and proper
notice of this election is given, in full conformity with the
Charter of the City of Fort Worth, Texas, and the applicable
statutes of the State of Texas.
SECTION XIV.
That this ordinance, election order, proclamation and
notice shall take effect and be in full force and effect from
and after the date of its passage, an it is so ordal ed.
