HomeMy WebLinkAboutOrdinance 7781 ORDINANCE NO. -77 AN ORDINANCE VACATING, ABANDONING AND CLOSING A 35 FOOT WIDE PUBLIC OPEN SPACE EASEMENT ON LOT 20, BLOCK 13, WOODHAVEN COUNTRY CLUB ESTATES, TO INCLUDE THE THREE 10 FOOT WIDE UTILITY EASEMENTS CROSSING LOT 20 NORTHWARD FROM BOCA RATON BOULEVARD, AND TERMINATING ALONG THE SOUTH LINES OF LOTS 16, 17, 18 and 19, AS RECORDED IN VOLUME 388-99, PAGE 48, PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the 35 foot wide public open space easement on Lot 20, Block 13, Woodhaven Country Club Estates, to include the three 10 foot wide utility easements crossing Lot 20 northward from Boca Raton Boulevard, and terminating along the south lines of Lots 16, 17, 18 and 19, as recorded in Volume 388-99, Page 48 Plat Records of Tarrant County, Texas, be and the same is hereby vacated, abandoned and permanently closed as an easement. SECTION 2. That the fee to the land in said easements is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APP VED TO FORMAND LEGALITY: . Ci y Attorn ADOPTED• 1-!3-'j9 EFFECTIVE: � t ' City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Easement Vacation - Woodhaven PAGE NUMBER Country Club Estates, Block 13, Lot 20, 8/8/78 PZ-867 Boca Raton Boulevard at High Woods Trail. 1 of 1 (V-78-11) Grover Riddle, owner of all abutting property, has requested that the City vacate the 35-foot wide public open space easement on Lot 20, Block 13, Woodhaven Country Club Estates, to include the three 10-foot wide utility easements crossing Lot 20 northward from Boca Raton Boulevard, and terminat- ing along the south lines of Lots 16, 17, 18 and 19, as recorded in Volume 388-99, Page 48, P.R.T.C.T. and as shown on the attached map. City departments and private utility companies have reviewed this request and have no objections upon submission and approval of a satisfactory replat. Such a plat has been submitted to staff. Recommendation It is recommended that an ordinance be adopted vacating the subject easement as requested.
