AN ORDINANCE VACATING, ABANDONING AND CLOSING A
15 FOOT SANITARY SEWER EASEMENT LOCATED WITHIN
LOTS 1 - 8, BLOCK A, AND LOTS 10 AND 11, BLOCK C ,
ASPEN WOODS ADDITION AS SHOWN ON A PLAT RECORDED
IN VOLUME 388-122, PAGE 29, PLAT RECORDS OF
TARRANT COUNTY, TEXAS, AND ALSO WITHIN LOT 1,
BLOCK 1, WEILERWOOD ADDITION AS SHOWN ON A PLAT
RECORDED IN VOLUME 388-96, PAGE 6, PLAT RECORDS
OF TARRANT COUNTY, TEXAS; PROVIDING FOR THE
REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
SECTION 1.
That the City vacate a 15-foot sanitary sewer easement
located within Lots 1-8, Block A,and Lots 10 and 11, Block C ,
Aspen Woods Addition as shown on a Plat recorded in Volume 388-122,
Page 29, Plat Records of Tarrant County, Texas, and also within
Lot 1, Block 1, Weilerwood Addition as shown on a Plat recorded
in Volume 388-96, Page 6, Plat Records of Tarrant County, Texas;
said easement being:
1) 15' sanitary sewer easement along Lots
1, 2, 3, 4, 5, 6, 7 and 8 of Block A,
Lots 10 & 11 of Block C of Aspen Woods.
2) 15' sanitary sewer easement on Tract 1-C,
W. J. Baker- Survey,Abstract 101, being
part of a tract of land conveyed to
Bilbev, Inc. , by deed recorded in Volume
5800, Page 426 of the Deed Records of
Tarrant County, Texas;and being more
particularly described as follows:
FROM a point in the northeasterly right-
of-way line of Weiler Road (a 60'R.O.W.) ,
said point being the northwest corner of
Lot 1, Block "J" of Eastern Hills Addition,
and said point lying in a circular curve to
the right of 473.64 foot radius; thence,
northwesterly with the northeasterly line
of Weiler Road, along said curve, an arc
distance of 113.10 feet through a central
angle of 13040'54" to the point of tangency;
thence, N34039'51"W, continuing with the
northeasterly line of Weiler Road, 371.59
feet to the point of beginning, said point
of beginning being the center line of the
herein described 15.0 foot sanitary sewer
easement; and said point being in the
westerly line of said Tract 1-C;
THENCE, N76004'58"E, departing from the
northeasterly line of Weiler Road, 152.88
feet to a point in the easterly line of
said Tract 1-C.
and the same is hereby vacated, abandoned and permanently closed
as an easement for a sanitary sewer.
SECTION 2.
That the fee to the land in said sanitary sewer easement
is hereby released and shall revert to the adjacent owners as
provided by law, SAVE AND EXCEPT that easements are retained for
any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage, and it
is so ordained.
