On November 7, 1978 (M&C C-4409), the City Council declared the necessity
for and ordered the improvements for the assessment paring of East 12th
Street, Project No. 013-024267-00 as described below, A construction
contract was awarded to Texas Bitulithic Company in the amount of $59,476.45
and December 5, 1978, was set as the date for the Benefit Hearing. All
adjacent property owners were notified of the hearing by certified mail on
November 17, 1978.
Project Description
Roadway R.O.W.
Street Limits Width-Feet Width-Feet
East 12th Street From Sylvania Avenue to 28 40
Baurline Street
Origin of Project
In April, 1970, a paving petition was accepted with valid signatures of the
owners of 53 percent of the abutting property. The paving of the street was
delayed as a result of litigation against the sale of bonds and in November,
1972, all the abutting property owners were re-polled to determine their
current desires regarding improving East 12th Street. The re-poll resulted
in the owners of 58 per cent of the abutting property voting for permanent
pavement. However, in April, 1973, after bids were received and the neighbor-
hood meeting conducted, the majority of the owners (56, 1 per cent) indicated
that they were against the improvements. The majority of the owners stated
that since the County had hot-topped the street, they no longer desired that
the City do the paving. The street was d'leted from the paving project at the
Benefit Hearing on June 11, 1973 (M&C G-2205).
On March 4, 1977, a paving petition was received in the Assessment Paving
Office, signed by the owners of 50 2 per cent of the adjacent property,
requesting the street be improved to City standards complete with curb,
gutter and driveway approaches.
Improvements
East 12th Street will be improved with residential grade hot-mix asphaltic
concrete pavement with concrete curb, gutter and driveway approaches and
required drainage appurtenances.

All property adjacent to East 12th Street is zoned residential and is being
assessed $8.50 per front foot for pavement, curb and gutter in accordance
with Standard City Policy. It is the opinion of the Public Works Director
that all adjacent properties will be enhanced in value by an amount to or
greater than the proposed assessment.
Recommendation
It is recommended that an ordinance be adopted closing the hearing and
levying the assessments as proposed.
