AN ORDINANCE VACATING, ABANDONING AND CLOSING
THE 10 FOOT WIDE UTILITY EASEMENT ADJACENT
AND PARALLEL TO THE EAST LINE OF LOT 1, BLOCK 2,
NEWELL & NEWELL INDUSTRIAL PARK, A LENGTH OF
605.6 FEET; PROVIDING FOR A REVERSION IN FEE
IN SAID LAND; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the 10 foot wide utility easement adjacent and
parallel to the east line of Lot 1, Block 2, Newell & Newell
Industrial Park, a length of 605.6 feet be and the same is
hereby vacated, abandoned and permanently closed as a utility
easement.
SECTION 2.
That the fee to the land in said utility easement is
hereby released and shall revert to the adjacent owners as
provided by law, SAVE AND EXCEPT that easements are retained
for any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and it
is so ordained.

Newell & Newell Ltd. Partnership, owner of Lot 1, Block 2, Newell & Newell
Industrial Park, has requested that the City vacate the 10 foot wide utility
easement adjacent and parallel to the east line of Lot 1, Block 2, Newell &
Newell Industrial Park a length of 605.6 feet, as shown on the attached map.
The easement, acquired by dedication, is not in use. Abandonment of easement
is requested in order to accommodate existing structures now encroaching within
the easement area.
City departments and private utility companies have reviewed this request and
offer no objections provided a replat of the property is furnished rededicating
an alternate easement. A satisfactory replat has been submitted to City staff.
Recommendation
It is recommended that an ordinance be adopted vacating the above easement as
recommended.
