'7jef.� AN ORDINANCE VACATING, ABANDONING AND CLOSING ELDON MARTIN STREET FROM A POINT 10 FEET EAST OF THE EAST RIGHT-OF-WAY LINE OF BOAT CLUB ROAD TO A POINT 30 FEET NORTH OF THE NORTH RIGHT-OF-WAY LINE OF TEN MILE BRIDGE ROAD, A WIDTH OF 60 FEET AND A LENGTH OF APPROXI- MATELY 810 FEET; A PORTION OF WRIGHT ARMSTRONG STREET, A WIDTH OF 60 FEET AND A LENGTH OF 524.3 FEET EASTWARD FROM THE EAST RIGHT-OF-WAY LINE OF ELDON MARTIN STREET, ADJACENT TO LOTS 1-6 AND WEST ONE-HALF OF LOT 7, BLOCK 4, AND LOTS 1 AND 14-18 AND THE WEST ONE-HALF OF LOT 13, BLOCK 2, WAYSIDE PARK ESTATES; ALL 10 FOOT WIDE UTILITY EASEMENTS IN BLOCK 1; ALL 10 FOOT EASE- MENTS BETWEEN LOTS 2 AND 3, 1-3, 4 AND 18 IN BLOCK 2; 10 FOOT ANCHOR EASEMENTS PROJECTING INTO LOTS 2 AND 4 IN BLOCK 2; AND 5 FOOT EASEMENTS ALONG THE REAR OF LOTS 14 THROUGH 18 AND THE WEST 33 FEET OF LOT 13 IN BLOCK 2; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Eldon Martin Street from a point 10 feet east of the east right-of-way line of Boat Club Road to a point 30 feet north of the north right-of-way line of Ten Mile Bridge Road, a width of 60 feet and a length of approximately 810 feet; a portion of Wright Armstrong Street, a width of 60 feet and a length of 524.3 feet eastward from the east right-of-way line of Eldon Martin Street, adjacent to Lots 1-6 and west one- half of Lot 7, Block 4, and Lots 1 and 14-18 and west one-half of Lot 13, Block 2, Wayside Park Estates; all 10 foot wide utility easements in Block 1; all 10 foot wide easements between Lots 2 and 3, 1-3, 4 and 18 in Block 2; 10 foot Anchor easements projecting into Lots 2 and 4 in Block 2; and 5 foot easements along the rear of Lots 14 through 18 and the west 33 feet of Lot 13 in Block 2, all said easements being in the said Wayside Park Estates, be and the same are hereby vacated, abandoned and permanently closed as street right-of-way and utility easements. SECTION 2. That the fee to the land in said right-of-way and easement segments is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. Lindsey, trustee, owner of Lots 1-20 Block 1• Lots 1-4 and 13-18 Block 2; and Lots 1-7, Block 4and Tract 2, William Dean Survey A-436, has requested ,Vjs'`Y� that the City vacate Eldon Martin Street from a point 10 feet east of the east right-of-way line of Boat Club Road to a point 30 feet north of the north right- of-way line of Ten Mile Bridge Road a width of 60 feet and a length of approxi- mately 850 feet: to vacate a portion of Wright Armstrong Street a width of 60 feet and a length of 524,3 feet eastward from Eldon Martin Street adjacent to Lots 1-6 and the west 1/2 of Lot 7, Block 4 and Lots 1 and 14-18' and the west 1/2 of of Lot 13, Block 2, Waysids. Park Estates; to abandon all 10 foot wide utility easements in Block l;and to abandon other utility easements in Block 2 as follows: 10 foot easement between Lots 2 and 3; 10 foot easement between Lots 1-3, 4 and 18; 10 foot anchor easements projecting into Lots 2 and 4 and the five foot easement along the rear of Lots 14-18 and the west 33 feet of Lot 13, all as shown on the attached map. The subject streets and easements, not open on the ground, were acquired by dedication. According to Fort Worth's Thoroughfare Plan, both Boat Club Road and Ten Mile Bridge Road are proposed for 120 foot rights-of-way; thus, an addi- tional 10 feet of right-of-way must be acquired along Boat Club Road and 30 feet additional right-of-way along Ten Mile Bridge Road. Where Eldon Martin Street currently intersects the two aforementioned rights-of-way, the proposed additional right-of-way in both instances has been eliminated from this vacation request and has been accounted for in the description of the vacation in the paragraph above. Reviewing City departments and public utility companies have reviewed this request and have no objections subject to a satisfactory replat of the vacated rights-of-way and easements with abutting property and dedication of additional rights-of-way and required easements, A satisfactory replat, including rights- cf-way and easement dedications, have been submitted and reviewed by City staff.
