HomeMy WebLinkAboutOrdinance 7890 ORDINANCE NO. 7 t, 4 C AN ORDINANCE AMENDING SECTION 1.12 OF EXHIBIT "A" OF THE PLUMBING CODE OF THE CITY OF FORT WORTH BY SETTING A FEE FOR THE ISSUANCE OF A REPERMIT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES OR PROVISIONS OF THE PLUMBING CODE OF THE CITY OF FORT WORTH; REPEALING ALL ORDINANCES OR PRO- VISIONS OF THE PLUMBING CODE OF THE CITY OF FORT WORTH IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PRO- VIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; DIRECTING PUBLICATION; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 1.12 - "Cost of Permit" - of Part I - "Admin- istration" - of Exhibit "A", attached to and incorporated by reference in the Plumbing Code of the City of Fort Worth (Ordinance No. 7626) , be and the same is hereby amended to read as follows: "SECTION 1.12 - COST OF PERMIT: "Every applicant for a permit to do work regulated by this code shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind of connection therewith, together with such information pertinent thereto as may be required. "Such applicant shall pay for each permit issued, a fee in accordance with the following schedule, and at the rate provided for each classification shown therein. "Any person who shall commence any plumbing work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted to obtain permit, pay double the permit fee fixed by this section for such work, provided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the Administrative Authority that such work was urgently necessary and that it was not practical to obtain a permit therefor before the commencement of the work. In all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. "The double permit fee required by the fee schedule shall be charged for work for which an inspection has been requested and no permit has been obtained. "For the purpose of this section a sanitary plumbing outlet on or to which a plumbing fixture or appliance may be set or attached or any plumbing fixture or appliance to which a water connection may be made, shall be construed to be a fixture. Fees for reconnection and retest of existing plumbing systems in relocated buildings shall be based on the number of plumbing fixtures, gas systems, water heaters, etc., involved. "When interceptor traps or house trailer site traps are installed at the same time as a building sewer on any lot, no sewer permit shall be required for the connection of any such trap to an appropriate inlet fitting provided in the building sewer by the permittee constructing such sewer. "SCHEDULE OF FEES Minimum Permit $ 5.00 First Fixture or Appliance 5.00 Additional Fixtures or Appliances 2.00 Sewer - First 120 Feet 5.00 Each Additional 100 Feet or Portion Thereof 5.00 Gas Service 5.00 Each Branch or Valve of Lawn Sprinkler 5.00 Water Service 5.00 Grease Trap 5.00 Sand Trap 10.00 Each Roof Drain 5.00 Temporary Gas Service 5.00 Backflow Preventer 5.00 Reinspection After First Turndown 5.00 Second Inspection After First Turndown 10.00 Third inspection After First Turndown 25.00 Floor Drain 2.00 water well 20.00 Mobile Homes or Mobile Units Each Mobile Home Space or Mobile Unit Space 15.00 Each Sewer Vent 10.00 Two (2) Times Fee for Work Started Without Permit Locked Door 5.00 Inspection Manhole 15.00 Repermit (issuance of 2nd 10% of original permit fee or subsequent permit with a minimum charge of for completion of $15.00" projectpreviously permitted) SECTION 2. That this ordinance shall be cumulative of the provisions of the Plumbing Code of the City of Fort Worth, except where the provisions of this ordinance are in direct conflict with the pro- visions of such Code, in which event conflicting provisions of such Code are hereby repealed. SECTION 3. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions -2- of the Plumbing Code of the City of Fort Worth, which have accrued at the time of the effective date of this ordinance; and as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such chapter or other ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 4. That it is hereby declared to be the intention of the City Council of the City of Fort Worth, Texas, that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable and if any section, paragraph, sentence, clause or phrase of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining sections, paragraphs, sentences, clauses or phrases of this ordinance since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitu- tional section, paragraph, sentence, clause or phrase. SECTION 5. That any person violating any of the provisions of this or- dinance shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each day or portion thereof during which any violation of any of the pro- visions of this ordinance is committed, continued or permitted and each violation shall be punishable by a fine not to exceed Two Hundred Dollars ($200.00) . SECTION 6. That the City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effec- tive date of this ordinance for five (5) days in the official -3- newspaper of the City of Fort Worth, Texas. SECTION 7. That this ordinance shall be in full force and effect from and after the date of its passage and publication as required by law and it is so ordained. Currently, the Plumbing Code does not provide for repermitting. Thus, when an owner changes plumbing contractors during a construction project, the Code requires issuance of and charging for a second permit. The intent of the proposed 6 de amendment is to replace this double charging with a more equitable repermitting fee. The proposed ordinance amending Section 1.12 0£ Exhibit "A" of the Plumbing Code of the City of Fort Worth is attached for consideration. Recommendation It is recommended that the attached ordinance amending the Plumbing Code by setting a fee for the issuance of a repermit be adopted.
