SUBJECT: Authorize Execution of a Contract with North Texas Contracting, Inc., in the Amount of
$1,029,708.20 for Clear Fork Drainage Basin M -210 Sanitary Sewer Improvements, Part
2, on Colonial Parkway and Rogers Road (COUNCIL DISTRICTS 3 and 9)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of a contract with North Texas
Contracting, Inc,, in the amount of $1,029,708.20 for Clear Fork Drainage Basin M -210 Sanitary Sewer
Improvements, Part 2.
DISCUSSION:
On April 13, 2010, (M&C C- 24176) the City Council authorized the City Manager to execute an
engineering Agreement with RJN Group, Inc., for the preparation of plans and specifications for Clear
Fork Drainage Basin M -210 Sanitary Sewer Improvements. The purpose of this project is to eliminate
sanitary sewer overflows in compliance with the Texas Commission on Environmental Quality (TCEQ)
' Sanitary Sewer Overflow Initiative.
The Construction of Part 1 of the project was completed in April 2012. This project, Part 2, is a
continuation of Part 1 and consists of the installation of approximately 1,400 feet of 42 -inch and 36 -inch
sewer line in Colonial Parkway. The project was advertised for bid on March 1, 2012 and March 8, 2012
in the Fart Worth Star- Telegrpm. On April 5, 2012, the following bids were received:
Alternate B allowed for HOPE pipe to be used as an alternative to concrete pipe for the storm drain pipe
adjustments. Bids for Alternative B marked with an ' were declared unresponsive. Staff has elected to
use Alternate A bids for the award of this contract.
MIWBE - North Texas Contracting, Inc., is in compliance with the City's MVJBE Ordinance by committing
to 23 percent MIWBE participation. The City's goal on this project is 17 percent.
In addition to the contract cost, $30,000.00 is required for construction staking, project management,
material testing and inspection and $31,000.00 is provided for project contingencies.

3 THIS AGREEMENT, authorized on June 12, 2012, is made by and between the City of Fort
-4 Worth, a Texas home rule municipality, acting by and through its duly authorized City Manager,
5 ( "City"), and NORTH TEXAS CONTRACTING Inc., authorized to do business in Texas, acting
6 by and through its duly authorized representative, ("Contractor').

18 3.1 Time is oft he essence.
19 All time limits for Milestones, if any, and Final Acceptance as stated in the Contract
20 Documents are of the essence to this Contract,
21 3.2 Final Acceptance.
22 The Work wili be complete for f=inal Acceptanee within 180 days aver the date when the
23 Contract Time commences to run as provided in Paragraph 2.03 of the General Conditions.
24 3.3 Liquidated damages
25 Contractor recognizes that time is of the essence of this Agreement and that City will
26 suffer financial loss if the Work is not completed within the times specified in Paragraph
27 3.2 above, plus any extension thereof allowed in accordance with Article 12 of the
28 General Conditions. The Contractor also recognizes the delays, expense and difficulties
29 involved in proving in a legal proceeding the actual loss suffered by the City if the Work
30 is not completed on time. Accordingly, instead of requiring any such proof, Contractor
31 agrees that as liquidated damages for delay (but not as a penalty), Contractor shall pay
32 City Three Thurr.>ivad- Dollars ($3 000) for each day that expires after the time specified
33 in Paragraph 3.2 for Final Acceptance until the City issues the Final Letter of
34 Acceptance.

Article 6. INDEMNIFICATION

Contractor covenants and agrees to indemnify, hold harmless and defend, at its own

expense, the city, its officers, servants and employees, from and against any and all

claims arising out of, or alleged to arise out of, the work and services to he performed

under this contract. This indemnification provision is specifically intended to operate

Successors and Assigns.

representatives to the other party hereto, in respect to all covenants, agreements and

obligations contained in the Contract Documents.

Severability.

Any provision or pert of the Contract Documents held to be unconstitutional, void or

unenforceable by a court of competent jurisdiction shall be deemed stricken, and all

remaining provisions shall continue to be valid and binding upon CITY and

CONTRACTOR.

Goveming Law and Venue.

This Agreement, including all of the Conlract Documents is performable in the State of

Texas. Venue shall be Tarrant County, Texas, or the United States District Court for the
