HomeMy WebLinkAboutOrdinance 24167-05-2020 Ordinance No. 24167-05-2020 AN ORDINANCE DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE FISCAL YEAR 2019-2020 FORT WORTH PUBLIC IMPROVEMENT DISTRICT 7 — HERITAGE FUND IN THE AMOUNT OF $204,304.00, AND INCREASING AVAILABLE UNRESERVED FUND BALANCE, FOR THE PURPOSE OF ADJUSTING REVENUE TO MATCH EXPENDITURES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager,there shall also be decreased estimated receipts and appropriations in the Public Improvement District 7—Heritage Fund in the amount of$204,304.00, and increased available unreserved fund balance, for the purpose adjusting revenue to match expenditures. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: The City of Fort Worth Department of Financial Management Services administers the City's Public Improvement Districts(PIDs),in accordance with Chapter 372 of the Texas Local Government Code.The City's PID Policy outlines the need to proactively work with the PID managers to oversee the services being provided by the PIDs and their associated financial positions.Staff,along with the contracted PID management companies,have conducted mid-year reviews of the Public Improvement District 7-Heritage(Heritage PID)Annual Budget(Budget)and recommend the following adjustments. The City contracts with FirstService Residential Texas PID, LLC(FirstService)to manage the Heritage PID. FirstService has identified the need to decrease the Heritage PID Budget by the use of fund balance in the amount of$204,304.00,in order to align expenses with actual activities in the Budget and Five-Year Service Plan. The expense decrease can be attributed primarily to planned activities being postponed,reduced,or interrupted by COVID-19.The proposed decrease in use of fund balance for Heritage PID will increase reserves in the fund balance. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current operating budget,as appropriated of the FWPID#7-Heritage Fund.Prior to any expenditure being incurred, the Financial Management Services Department has the responsibility to validate the availability of funds.
