AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE STORMWATER CAPITAL
PROJECTS FUND BY DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE LEBOW CHANNEL ROADWAY CROSSING PROJECT IN THE AMOUNT OF
$500,000.00, AND INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE STORMWATER HAZARDOUS ROADWAY OVERTOPPING PROGRAMMABLE
PROJECT, BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the
Budget of the City Manager, there shall also be adjusting appropriations in the Stormwater Capital Projects
Fund by decreasing estimated receipts and appropriations in the Lebow Channel Roadway Crossing
Project in the amount of $500,000.00, and increasing estimated receipts and appropriations in the
Stormwater Hazardous Roadway Overtopping Programmable Project, by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Adopt Appropriation Ordinance in the Amount of$500,000.00 to Expedite Construction of Critical Hazardous Roadway Overtopping Mitigation
Projects and Update the FY 2020-2024 Capital Improvement Plan (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached Appropriation Ordinance adjusting receipts and appropriations in the Stormwater
Capital Projects Fund by decreasing receipts and appropriations in the Lebow Channel Roadway Crossing project(City Project No. C00778)in
the amount of$500,000.00 and increasing appropriations in the Stormwater Hazardous Roadway Overtopping programmable project(City
Project No. P00120)by the same amount.
DISCUSSION:
In light of the anticipated revenue bond sale in Fall 2020 made possible by the recent Stormwater Utility Fee increase,staff recommends
accelerating efforts to expedite construction of critical Hazardous Roadway Overtopping Mitigation (HROM)projects.The Lebow Channel project
is nearing completion,and residual funds may be reallocated for other use.The$500,000.00 in additional funding being reallocated by this M&C
will provide for task-ordered engineering services for initial design efforts for major HROM and safety improvement projects,which are currently
being prioritized and developed,and task-ordered construction of safety improvements.The design engineers will be selected through a
qualification-based process.The construction contractor will be selected through a competitive procurement process.
Funding for the HROM programmable project was included in the FY2020-2024 Capital Improvement Plan in the amount of
$257,042.00.Additional funding in the amount of$500,000.00 is needed to accelerate construction of critical HROM projects. The action in this
M&C will update the FY2020-2024 Capital Improvement Plan.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies upon approval of the above recommendation and adoption of the attached appropriation ordinance,funds will be
available in the Stormwater Capital Projects Fund SW Hazardous Rd Overtopping programmable project. Prior to an expenditure being incurred,
the Transportation&Public Works Department has the responsibility of verifying the availability of funds.
