AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $446,678 AND THE
WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $194,788 FROM A WATER
AND SEWER OPERATING FUND TRANSFER, FOR THE PURPOSE OF EXECUTING
AN ENGINEERING AGREEMENT WITH DUNAWAY ASSOCIATIES, L.P., FOR
SANITARY SEWER REHABILITATION CONTRACT, LXXI (71) (CITY PROJECT NO.
00414); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $446,678 and the Water Capital Projects Fund in the amount
of $194,788 from a Water and Sewer Operating Fund transfer, for the purpose of executing an Engineering
Agreement with Dunaway Associates, L.P., for Sanitary Sewer Rehabilitation Contract, LXXI (71) (City
Project No. 00414).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
ADOPTED AND EFFECTIVE: July 10, 2007
This ordinance shall take effect upon adoption.

Authorize Execution of an Engineering Agreement with Dunaway Associates, L.P., for Sanitary
Sewer Rehabilitation Contract, LXXI (City Project No. 00414) and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $641,466 from the Water & Sewer Operating Fund to the Sewer Capital Projects
Fund in the amount of $446,678, and the Water Capital Project Fund in the amount of $194,788;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Sewer
Capital Projects Fund in the amount of $446,678, and the Water Capital Project Fund in the amount of
$194,788, from available funds; and
3. Authorize the City Manager to execute an Engineering Agreement with Dunaway Associates, L.P., in the
amount of $554,440 for Sanitary Sewer Rehabilitation Contract, LXXI (71).
DISCUSSION:
The project consists of the preparation of plans and specification for the rehabilitation of the following
severely deteriorated sanitary sewer mains and laterals:
M-166: Beginning from a point located 300 feet southeast of the
Glen Garden Drive/Blackwell lane Intersection,
northwesterly 300 feet, then northerly 200 feet, then
northwesterly 200 feet and northerly 100 feet
M-1-1-1: Beginning from a point located 200 feet east of the
Samuel Avenue/Northport Court intersection, westerly
200 feet, then southerly 200 feet, then westerly 200 feet,
then southwesterly 350 feet
L-336: Located in the alley between Jessamine Street and
Ramey Avenue from New York Avenue to Mississippi
Avenue
L-529/L-530/L-531/L-534/L-536/L-540: Located in an area that is generally bound on the north
by Greer Street, on the south by Garvey Street, on the
east by Burlington Northern and Santa Fe Railroad Right-
Of-Way (BNROW) and on the west by Samuels Avenue.

In addition, design will be provided for replacement of the
severely deteriorated water main located on Greer Street
(Samuels Avenue to BNROW) and Garvey Street (Cold
Springs Road to BNROW)

intersection, northerly along Cold Springs Road to the
Windmill Street/Cold Springs Road intersection, then
westerly 200 feet along Windmill Street
L-4124: Beginning from the Cold Springs Road/Gilmore Street
intersection, northerly along Cold Springs Road to the
Windmill Street/Cold SSprings Road intersection,
then westerly 200 feet along Windmill Street
L-7006/L-7095/L-7096/L-8351 Beginning from the Whistler Dirve/Westrock Drive
intersection, easterly along Whistler Drive to the Trail
Lake Drive/Whistler Drive intersection, then southerly '
along Trail Lake Drive to the Hastings Drive/Trail Lake
Drive intersection, then westerly along hastings Drive to
the Fallworth Court/Hastings Drive intersection, then
southerly 400 feet and westerly 300 feet along with Fallworth
This engineering agreement will also provide the necessary design services for the replacement of the
severely deteriorated water mains located on Hampton Street (Cold Springs Road to Waterman Street),
Hays Street (Johnson Street to Peach Street), Diamond Road (Peach Street to Pharr Street), and Pharr
Street (Diamond Road to Live Oak Street).
All disturbed segments of pavement will be permanently repaired with asphalt after the proposed
improvements are complete.
Dunaway Associates, L. P., proposes to perform the necessary design and survey work for a lump sum fee
of $554,440. City staff considers this fee to be fair and reasonable for the scope of services proposed.
In addition to the contract amount, $87,026 (sewer: $60,050, water: $26,976) is required for project
management by the Engineering Department.

Dunaway Associates, L. P., is in compliance with the City's MMBE Ordinance by committing to 31 percent
M/WBE participation. The City's goal on the project is 28 percent.
The project is located in COUNCIL DISTRICTS 2, 6, 8 and 9, Mapsco 63 N, S, W, 77 H, P, T, V, Z, 89W,
91 L, M, 102 D and 103 A.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Sewer and Water Capital Projects Funds.
