HomeMy WebLinkAboutResolution 875 A Resolution WHEREAS, on January 12, 1982 , the City Council approved M&C G-5201 re- taining H. Louis Nichols as outside legal counsel to represent the City of Fort Worth, the City Plan Commission and its mem- bers in the pending lawsuit styled Booth Creek Investment, Inc. , and Jade West, Inc. v. City of Fort Worth, et al (hereinafter referred to as Jade West I) ; and WHEREAS, at the time the City Council approved M&C G-5201, it also adopted Resolution No. 822 fixing in advance as far as practi- cable, the sum of $7, 000 to be paid Mr. Nichols for his legal representation in Jade West I and other matters relating thereto; and WHEREAS , on August 11, 1982 , Booth Creek Investment, Inc. , and the Jade Group, Inc. d/b/a Jade West sued the City of Fort Worth, the Fort Worth City Council, the City Plan Commission, and their respective members in the lawsuit styled Booth Creek Invest- ment, Inc. , and The Jade Group , Inc. d/b/a Jade West v. The City of Fort Worth, et al (hereinafter referred to as Jade West II) ; and WHEREAS, because the Jade West II lawsuit is of extraordinary importance, it is necessary to retain H. Louis Nichols as outside counsel to represent the City, the City Council, the City Plan Commis- sion, and their respective members in this matter; and WHEREAS , it is also necessary to increase by $3, 000, from $7, 000 to $10, 000, the amount of money authorized to pay Mr. Nichols for his services pertaining to Jade West I and other matters relating thereto; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That H. Louis Nichols be retained as outside legal counsel, pursuant to Section 3, Chapter VI, of the City Charter, to ... represent the City, the City Council, the City Plan Commis- sion, and their respective members, in the pending Jade West II lawsuit. O CITY OF FORT WORTH SECTION 2. That, as far as practicable, the compensation to be paid H. Louis Nichols for his services relating to the preparation and trial of the Jade West II lawsuit through the District Court, without further appeal, be fixed in an amount not to exceed $7,000. SECTION 3 . That the compensation to be paid H. Louis Nichols for his services relating to the preparation and trial of the Jade West I lawsuit through the District Court, without further appeal, be increased from $7,000 to $10, 000.
