HomeMy WebLinkAboutOrdinance 24224-06-2020 Ordinance No.24224-06-2020 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, SUBJECT TO RECEIPT OF THE GRANT, IN THE AMOUNT UP TO $40,411.00, FOR THE PURPOSE OF FUNDING THE 2020 DEVELOPMENT AND IMPLEMENTATION OF FAIR HOUSING EDUCATION WORKSHOPS, PROJECTS AND ACTIVITIES FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund, subject to the receipt of grants, in the amount up to $40,411.00, for the purpose of funding the 2020 Development and Implementation of Fair Housing Education workshops, projects and activities through the United States Department of Housing and Urban Development. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision,opinion or judgment shall in no way impair the remaining portions,sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. The proposal is broken down into four projects with an outline of activities, timeline, cost(s) and expected impact under each proposal. HUD COV19 FHAP Partnership Fund Request Project 1: Partner with City of Fort Worth Faith Based Organizations (FBOs),the Fort Worth Independent School District(FWISD),and City staff to distribute informational flyers on COVID19& Fair Housing. Activities: 1. Develop a one page flyer providing fair housing information, and referral resources,to be distributed to: 1)the more than 275 FBOs in the City of Fort Worth, 2)the FWISD Meals to Go distribution sites, and 3)to City Code officers and Neighborhood Police Officers(NPOs). Attachment A includes a list of FBOs registered with the City of Fort Worth, and Attachment B includes a list of FWISD's Meals to Go sites. 2. Provide a link on the flyer, whereby the same information can be downloaded for FBO and neighborhood newsletters, emails, etc. 3. Print 100 count bundles of the flyers. 4. Deliver 100 count bundles flyers to each of the Fort Worth Independent School District's Meals to Go sites: 5. Using the City's database of FBOs, download addresses for all the FBOs in Fort Worth. 6. Using volunteer staff, prep flat rate Priority Boxes (limit 70 Ibs)with 100 of the informational flyers,and other City of Fort Worth fair housing promotional items. The prep station could be located in a facility that has enough room to space out, 6 ft. apart, a group of 4-5 volunteers. 7. Mail as a "care" package to each FBO, hand deliver to the Meals to Go sites, and provide bundles to City staff. • Postage costs: Approximately$5,000 • Print costs: 36,800 color flyers @ .10 a flyer=$3,680 • Timeline: May—August 2020 • Expected Impact: The information flyer will serve as a resource to the community to address their questions about COVID19 and their fair housing and renter's rights. Potential number of residents receiving the flyers, and/or information could number well over 40,000 people. Project 2: Partner with Fort Worth Businesses to Share Information About COVID19 Resources With Their Customers Activities: 1. Develop a COVID19 Resource Poster with information similar to the flyer. 2. Print Posters 3. Using volunteers, Code officers,and/or NPOs to distribute posters to grocery stores, child care facilities, etc. 4. Print a surplus of posters for businesses to pick up,through an appointment, on their own. • Poster costs: 1,000 posters at$2.00 each =$2,000 • Mileage Reimbursement: 20 volunteers driving 100 miles each =4,000 miles @.58 a mile=approx. $1,200 • Timeline: May—August 2020 • Expected Impact: The posters have the potential to be seen by more than 10,000 business customers (1,000 posters x 10 views per business). Project 3: Social Media Campaign—Geo-fencing Activities: 1. Share messages regarding COVID19 community safety measures and information about fair housing discrimination related to COVID19 via the city's existing Facebook pages. 2. Increase engagement on city's existing Facebook pages via advertising that expands existing audience by targeting identified interest and behavioral criteria, as well as geographic locations. • $35/week per targeted message with an estimated four messages a month for a total of$560 every four weeks. Total cost for a six month campaign=$3,360 • Timeline: May 2020 thru December 2020 • Expected Impact: The campaign has the possibility of reaching more than 50,000 people through social media and potential "shares." Project 4: Technology for Telework(During COVID19 and future COOP events) As the nation is faced with a new norm due to the COVID19 pandemic',the ability for investigators to telecommute is imperative. A. Ali-In-One Laser Printers/Scanners: Each fair housing investigator currently has access to a laptop, but does not have access to a printer and scanner at home. A printer and scanner are imperative for investigations, as it allows the investigator to scan and upload documents into HEMS, print documents,obtain signatures,and scan the document with signatures back to Administration (and upload in HEMS). Cost Analysis: A review of ratings for all in one laser devices(color printer,copier,and scanner)from various reviewers(i.e.: PC Mag,Tom's Guide, Forbes,and Popular Mechanics) show costs for the top reviewed devices between$340.00 and $450.00: Specifications and Needs: Desired Specifications Needs All in One Capabilities Need the ability to print and scan from one device to avoid separate purchases. Color Scanning This is of particular importance when scanning pictures provided by parties to a complaint. Otherwise the individual would have to lift lid, place sheet, and scan for each separate page. Laptops for Telework Purchase 3 laptops for administrative staff and intake staff. Currently staff is teleworking and the Fair Housing Investigators have permanent laptops assigned to them. However,the Assistant Director of Civil Rights Enforcement and the two intake eligibility specialist have desktop computers. The purchase of the 3 laptops will allow staff, not assigned laptops,to work remotely. Information on City of Fort Worth Equipment Purchases—The City's Information Technology departments provides that the reason our laptops are more expensive is because we select a different line of products from our vendors,than what is offered on the shelf(see specifications included in Attachment C).What you will find on-the-shelf, are pcs configured for small businesses.Our computers are built by our vendor for large businesses and are configured to align with the City's business needs.While an off-the shelf device may meet your immediate need, it may not meet the needs of your business long-term due to the many types of applications that are used on a daily-basis. Depending on the types of applications that you use on a daily basis,they may take up a lot of memory and storage space, more than most off-the-shelf have to offer which may make the off-the-shelf laptop more sluggish,slowing down user productivity. Also,included inside each quote is a line item for tagging our devices, imaging our devices, and the cost to dispose of each pc at the end of its life. We also have purchasing polices and contracts that bind us to certain vendors.This is not to say that we cannot quote you on something different and a little less expensive than our current standard, it is only to say that we are limited on what vendors were are authorized to use. Summary The Fort Worth Human Relations Commission (HRC)was created in 1967 to champion anti-discrimination efforts in Fort Worth and facilitate harmonious relationships among Fort Worth's diverse communities.Working under the direction of the HRC,the city's Diversity and Inclusion Department enforces the local,state and federal anti- discrimination laws and works to create a welcoming community for all people by providing resources and outreach efforts that promote basic human and civil rights. As part of those efforts,the City's Diversity and Inclusion Department is proposing a series of fair housing training workshops targeting housing providers,tenants and community agencies. The trainings,which will be held sometime in between June through October 2020,will provide timely and relevant information about Fair Housing topics and issues impacting the Fort Worth community.Program content will be diverse and timely,with subject matter experts with regional and/or national credentials with several topics addressing Fair Housing. Proposed Fair Housing workshops include: Housing Providers: • What does Fair Housing mean? Overview of Federal,State and Local laws. • Assisting tenants with disabilities: An overview of Reasonable Accommodations and Modifications,emotional support animals and federal guidance. • Rules for tenants with children: An overview of Familial Status discrimination. • Housing protections for victims of domestic violence. Community Members: • Know your Fair Housing Rights. • How to request a reasonable accommodation/modification. • Understanding the difference between landlord/tenant laws and fair housing law. • National Origin discrimination-What does this mean and how does it impact me? • How to file a fair housing complaint. Outside Social Service Agencies: • What is Fair Housing and How Does It Impact the Work I Do? • Assisting clients with Fair Housing issues. • How to file a fair housing complaint. Page 2 of 5 II. Introduction Since its creation in 1967 by the passage of City Ordinance#5802,the Human Relations Commission has been tasked with three specific duties: • Advise and consult with the City Council and City Manager on matters of discrimination • Recommend to the City Council and City Manager measures to eliminate prejudice and discrimination • Promote and encourage communication and cooperation between groups interested in bettering community relations. To accomplish this work,the Commission holds monthly public meetings and monitors complaints of discrimination and trends. Members of the Commission also serve as the eyes and ears of the City. They bring relevant issues impacting the community before the entire Commission for discussion. The Commission also hears and renders decisions in complaints of housing discrimination that have been filed with and investigated by the Human Relation Unit. In recent years,the HRC has turned its focus to providing more opportunities for education and community outreach as funding,grants and community partnership opportunities become available. The proposed training workshops,which would be funded with HUD partnership funds, provides an opportunity for the HRC to engage,educate and provide resources and information to housing providers so that they understand their obligations under the Fair Housing Act;information for individuals so that they may understand their Fair Housing rights and how to exercise those rights;and,information and training for outside social service agencies that serve vulnerable populations so that they can better serve their clients. III. Needs/Problems The City of Fort Worth's Diversity and Inclusion Department,newly formed in FY2020, consists of staff that enforce civil rights laws,staff that works to increase and ensure business diversity,and staff that is working to ensure in equity and inclusion in the delivery of City services as well promoting diversity and inclusion in criminal justice,economic development,education,health,housing,governance and transportation. Diversity and Inclusion staff,with input from the Fort Worth Human Relations Commission,the Mayor's Committee on Persons with Disabilities and other community stakeholders has identified a need to provide on-going information and resource opportunities to housing providers, the Fort Worth community and other social service agencies with similar and/or symbiotic relationships. Some of the issues taken into consideration include: • Selecting programming that addresses needs/concerns/interest of conference target audience. • Marketing the programming to bring in diverse audiences. CONTIGENCY PLANS: In the event that the current Coronavirus epidemic continues into the summer months,the agency will offer the programming/training through a series of webinars. IV. Goals/Objectives • Provide relevant programming for 100 to 300 housing providers,community members, and social service agencies about Fair Housing obligations,rights,and responsibilities under the law. • Program contents will be diverse and timely,with subject matter experts with regional and/or national credentials with several topics covering Fair Housing. V. Authorize Execution of Related Agreement,and Adopt Appropriation Ordinance(ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that City Council: 1. Ratify the application for and authorize the acceptance of the cooperative agreement with the United States Department of Housing and Urban Development for Partnership Funds in the amount up to$40,411 for the development and implementation of fair housing education workshops,projects and activities; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund in an amount up to$40,411 upon receipt of the award. DISCUSSION: On an intermittent basis the United States Departments of Housing and Urban Development(HUD)will seek proposals for use of Fair Housing Partnership Funds,if available,under the authority set forth at 24 C.F.R.§115.304(d). The purpose of Partnership Funds is"for an agency participating in the FHAP to utilize the services of individuals and/or public,private,for-profit,or not-for-profit organizations that have expertise needed to effectively carry out the provisions of the agency's fair housing law." On March 4,2020, HUD notified all Fair Housing Assistance Program(FHAP)agencies that it would be accepting applications for 2020 Partnership Funds,with a deadline for submittal of March 18,2020. The Fort Worth Human Relations Commission(FWHRC)applied for this award proposing to develop and implement a series of three fair housing education workshops targeting housing providers,tenants and social service/community agencies. The workshops would be implemented between the timeframe starting May 1.2020,and ending April 30,2021. The proposed fair housing education content for each workshop will be developed based on the needs of each target audience,and be facilitated/taught by subject matter experts with regional and/or national credentials. Proposed content includes: Housing_Providers •What does Fair Housing mean? Overview of Federal,State and Local laws. •Assisting tenants with disabilities: An overview of Reasonable Accommodations and Modifications,emotional support animals and federal guidance. •Rules for tenants with children: An overview of Familial Status discrimination. •Housing protections for victims of domestic violence. Community Members •Know your Fair Housing Rights. •How to request a reasonable accommodation/modification. •Understanding the difference between landlord/tenant laws and fair housing law. •National Origin discrimination—What does this mean and how does it impact me? •How to file a fair housing complaint. Outside Social Service/Community Agencies •What is Fair Housing and How Does It Impact the Work I Do? •Assisting clients with Fair Housing issues. •How to file a fair housing complaint. On March 27,2020,the FWHRC received notice from HUD that our proposal for the series of fair housing education workshops had been selected for funding,in the amount of$17,500,with an effective date for the Agreement starting April 3,2020. On April 20,2020,HUD received additional funding,through the CARES Act,to award additional partnership funds to Fair Housing enforcement agencies for COVID19 related Fair Housing projects and/or activities. The FWHRC applied for this additional award,proposing several COVID19/Fair Housing outreach and education activities and funding for technology to support telework. On May 26,2020,the FWHRC received notice that it was being awarded$22,911 in support of this proposal,with an effective date for the performance period starting June 1,2020 and ending December 1,2020. The total of the two awards is$40,411. Indirect costs are not submitted on the grant due to no payroll expenditures in the grant award. The grant award is to pay for venue costs,speaker fees,accessibility services, registrant supplies,and marketing. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:U.S. Department of Housing and Urban Development FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations,receipt of the grant and adoption of the attached appropriation ordinance,funds for operation will be available in the current operating budget,as appropriated,of the Grants Operating Federal Fund.
