HomeMy WebLinkAboutResolution 647 t � � No. �- A Resolution ' , SETTING FORTH THE PROCEDURES TO BE FOLLOWED BY THE CITY OF FORT WORTH IN ABATING ENCROACH- MENTS UPON PUBLIC STREETS, ALLEYS AND GROUNDS PURSUANT TO ARTICLE 1175, SECTION 18, TEX. REV. CIV. STAT. WHEREAS, the City of Fort Worth, a home rule municipal corporation, is authorized by Article 1175, Section 18, TEX. REV. CIV. STAT , to control, regulate and remove all obstructions or other encroachments or encumbrances on any public street, alley or ground; and WHEREAS, it is the desire of the City Council that no one be deprived of any property without due process of law; NOW, THEREFORE, LET IT BE RESOLVED by the City Council of the City of Fort Worth that when an obstruction or other en- croachment or encumbrance shall exist upon any public street, alley or ground, the City Manager or his designee shall: 1 . Notify the owner, or person responsible for such ob- struction, encroachment or encumbrance, in writing, that an obstruction, encroachment or encumbrance exists. 2 . Instruct the owner, or person responsible for such obstruction, encroachment or encumbrance, in writing, to remove the obstruction, encroachment or encumbrance with- in ten calendar days. 3 . Notify the owner, or person responsible for such ob- struction, encroachment or encumbrance, in writing, that if the obstruction, encroachment or encumbrance is not removed that citations and possibly warrants will be issued. 4. Notify the owner, or person responsible for such obstruction, encroachment or encumbrance, in writing, that fees will be charged for removing and storing the material constituting such obstruction, encroachment or encumbrance. 13 CITY AF FART W RTU Page 2 5. Notify the owner, or person responsible for such ob- struction, encroachment or encumbrance, in writing, that he has a right to be heard before a duly-appointed board or the Council before the City removes the obstruction, encroachment or encumbrance. 6. Notify the owner, or person responsible for such ob- struction, encroachment or encumbrance, in writing, that removed items may ultimately be sold at auction in order that the City may recoup removal and storage fees. This resolution shall take effect immediately from and after its passage, and it is accordingly so resolved. 94" MP MRT WORTH
