HomeMy WebLinkAboutResolution 666 A Resolution WHEREAS , a public necessity exists for the City of Fort Worth, Texas , to acquire the entire fee simple title in and to Lots 13 , 14, 15 , and 16 and the east one-half of the adjacent closed alley, Block 114, of the Original Town of the City of Fort Worth, Texas , said addition also being known as City Addition to the City of Fort Worth, Texas ; and WHEREAS, the said lots or parcels of land are subject to the terms of a lease. from. H.H. Morse and R. Daniel Settle, co-trustees of the estate of Elizabeth Scott, deceased, the fee owners thereof , to Washer Brothers Corporation, the term of said lease commencing June 30, 1943, extended and amended for a term ending June 30, 1980; and WHEREAS , the City of Fort Worth has heretofore acquired the ownership of the fee title of the said land, subject however, to the lease in favor of Washer Brothers Corporation, as aforesaid; and WHEREAS, the City of Fort Worth has been unable to agree with Washer Brothers Corporation, the owner of the leasehold interest in said land upon the possession of said leasehold interest ; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: That a public necessity exists that the entire fee simple title in and to Lots 13 , 14, 15 , and 16 and the east one-half of the adjacent closed alley, in Block 114 of the Original Town of the City of Fort Worth in Tarrant County, Texas , said addition also being known as City Addition to the City of Fort Worth, be acquired for the public uses and public purposes described herein. That the Public uses and purposes for which said land is to be acquired are: To establish, acquire, lease as lessor or lessee, construct, improve, enlarge, equip, repair, operate and maintain structures , parking areas , parking garages or facilities for off-street parking or storage of motor vehicles or other conveyances ; to build, improve or construct a public square or squares , pedestrian plazas or pleasure grounds; or for any other municipal purposes that may be deemed advisable by the City Council of the City of Fort Worth. O _,-L� C1TY OF FORT WORTH That despite diligent and good faith efforts on behalf of the City of Fort Worth to reach an agreement with Washer Brothers Corporation, the owner of the above described leasehold interest in the said land, as to the acquisition of said land or damages , the City of Fort Worth and Washer Brothers Corporation, have been unable to agree upon the date of possession of said leashold interest. That the City Attorney should be and he is hereby authorized to institute eminent domain proceedings for the purpose of ac- quiring the leasehold interest of Washer Brothers Corporation, in and to Lots 13, 14, 15, and 16 and the east one-half of the adjacent closed alley in Block 114 of the Original Town of the City of Fort Worth in Tarrant County, Texas , said addition being also known as City Addition to the City of Fort Worth and to prosecute same to a conclusion against the owners of said leasehold interest.
