WHEREAS , at the regular meeting of the Fort Worth City Council
on December 18, 1979 , there was presented Mayor and Council Communi-
cation No. G-4358 Revised, dated December 4 , 1979 , from the City
Manager, recommending that an ordinance be adopted amending Chapter 12
of The Code of the City of Fort Worth, Texas (1964) , as amended ,
relative to the Municipal Courts of the City of Fort Worth, and to
Mayor and Council Communication No. G-4358 Revised - Supplement
clarifying certain specific provisions in the proposed ordinance as
requested by the City Council and recommending that an ordinance be
adopted. Councilman Davis made a motion, seconded by Councilman
Williams , that the recommendations , as contained in Mayor and Council
Communication No. G-4358 Revised and G-4358 Revised - Supplement , he
adopted; and
WHEREAS , when said motion was put to a vote by the Mayor , i.t
prevailed with Mayor Woods , Mayor Pro-tem Newkirk, and Councilmen
Zapata, Martin, Davis , Williams , Bolen and Stute voting "Aye" and
only Councilman Bagsby voting "No" ; and
�.► WHEREAS , the Ordinance so adopted, the same being Ordinance
No . 8018 of the City of Fort Wort , provided in Section 2 thereof
as follows :
"SECTION 2 .
"That Section 12-2 of Chapter 12 - COURTS , Article I , In
I General , of the Code of the City of Fort Worth (1964) , as
amended, is hereby amended and being so amended the same shall
hereafter be and read as follows :
' Section 12-2. Judges; qualifications; appointment ;
compensation; vacancies and oath
'A. Each Municipal court shall be presided over by .a
Judge who shall be known as the 'municipal judge, '
who shall be a licensed attorney in good standing
with two (2) or more years of experience in the prac-
tice of law in this County, shall be a citizen of the
United States and of the State of Texas and a resident
of the City. Municipal Judges shall maintain their
residences within the City during their tenure of
office, shall devote their entire time to the duties
of their office and shall not engage in the private
practice of law while so employed.
'B. Municipal Judges shall be selected and appointed
or reappointed to office by the City Council . Their
term of office shall be r two years commencing

April 1st , of each even numbered year, unless a
shorter term is specifically provided by the Council
at the time the appointment is made or unless sooner
removed by the Council on account of incompetence to
discharge the duties of their office, partiality ,
oppression, official misconduct, habits and conduct
rendering them unfit to hold such office , negligently
failing to perform their duties as judge, or failure
to execute in reasonable measure the business in their
courts , of which matters the Council shall be the sole
judge , and the Council ' s action regarding the same
shall be final.
'C . Municipal judges shall receive a salary, to,be
set by the City Council , which may not be diminished
during their terms of office.
'D. The City Council may appoint any number of quali-
fied persons to act in the place of any municipal judge
who may be absent or incapacitated because of illness ,
'+! family death or illness , continuing legal or judicial
education programs , or otherwise . The appointment or
reappointment of substitute municipal judges shall be
for terms not to exceed one (1) year and shall be initiated
upon the recommendations of the Chief Judge concurred in by
the Municipal Court Advisory Committee. In the absence of
a municipal judge and subject to budgetary constraints the
chief judge or his or her designee shall call on one of
such appointees to serve. While so serving the selectee
shall have all the powers and discharge all the duties of
the office and shall receive the same compensation that is
payable to the regular municipal judge.
'E. Municipal judges and substitute municipal judges
shall take the oath of office as prescribed by Section 30 ,
Chapter XXVIII of the Charter of the City of Fort Worth. .
'F. The Mayor, with the confirmation of the City Council ,
shall annually designate one (1) of the four (4) municipal
judges as Chief Judge' " ; and
WHEREAS, through inadvertance, the changes in said Section 2 ,
as proposed and adopted by the City Council pursuant to M&C Revised-
Supplement were not copied into the Minutes of said December 18, 1979 ,
meeting nor were they incorporated into the said Ordinance as
engrossed and enrolled on the Ordinance records of the City and
promulgated on December 20, 21 , 24, 26 and 27 , 1979 ; and
WHEREAS, correction of the Minutes , Ordinance records and
and any other records maintained by the City Secretary pertaining to
the said Ordinance is essential ; NOW, THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
.r SECTION 1 .
That the City Secretary shall and is hereby directed to
correct the minutes of the regular Council meeting of the Fort
Worth City Council held on December 18, 1979 , to accurately
reflect the text of the Ordinance adopted amending Chapter 12 of
the Code of the City of Fort Worth (1964) , as amended, and to
correct all records in his office and under his control reflecting
the correct text of Ordinance No . 8018 , specifically as to Section 2
thereof as hereinabove set forth; and
SECTION 2 .
That this Resolution be published for five days in the
official newspaper of the City and it is accordingly so Resolved.
