COMMUNITY ACTION PLAN AGREEMENT
This contract is made by the City of Fort Worth, Texas, a home rule municipal corporation situated
in Tarrant, Denton, Parker and Wise Counties, Texas, hereinafter called "City", and Tarrant County
Workforce Development Board dba Workforce Solutions for Tarrant County, hereinafter called "Workforce
Solutions" or sometimes collectively referred to as the "Parties."
1. SCOPE OF SERVICES
The City of Fort Worth through the Community Relations Department agrees to conduct the
following activities to further the Early Childhood Matters Initiative:
a) Parenting sessions: Conduct sessions with parents, grandparents and other caregivers
about what they can do to help their children be ready for kindergarten beginning at
birth during June and July 2009.
b) Participation Incentives: Purchase non -cash incentives for participants attending any
Early Childhood Matters parenting sessions such as food, diapers, cleaning supplies,
toys, educational materials, clothing, tools, small appliances, domestic goods, and tickets
to educational or cultural venues such as museums or the zoo.
c) Marketing and Outreach Materials: Update and/or create new marketing materials
including identity brochures, flyers and other collateral materials to publicize the
program for summer and fall 2009.
d) Evalaration: Analyze participant questionnaires, using an external evaluator, to measure
the effectiveness of program activities from a quantitative standpoint.
2. COMPENSATION
a) The maximum amount to be paid to the Community Relations Department for all services
rendered and all expenses incurred hereunder shall not exceed Twenty Five Thousand Dollars
b) Requests for compensation will be billed periodically on a reimbursement basis, with payment
being due within thirty (30) days from the date the invoice is received.
c) The date of the fmal invoice to Workforce Solutions will be September 30,
3. TERM The term of this Agreement shall be from the last date of execution by all parties to
September 30, 2009.
4. TERMINATION
a) City may terminate this Agreement for any reason, at any time, with or without cause, or for the
convenience of the City by thirty (30) days' notice in writing to Workforce Solutions.
5. INDEMNIFICATION; LIABII ITY
Workforce Solutions shall indemnify and hold the City and its officers, agents and employees
harmless from any loss, damage, liability or expense for damage to property and injuries, including death, to
any person, including but not limited to officers, agents or employees of Consultant or subcontractors, which
may arise out of any negligent act, error or omission in the performance of this Agreement.
6. PROHIBITION OF ASSIGNMENT
Neither party hereto shall assign, sublet or transfer their interest herein without the prior written
consent of the other party, and any attempted assignment, sublease or transfer of all or any part hereof
without such prior written consent shall be void.
7. CHOICE OF LAW; VENUE
This Agreement shall be construed in accordance with the laws of the State of Texas. Should any
action, at law or in equity, arise out of the terms of this Agreement, exclusive venue for said action shall be in
Tarrant County, Texas.
8. RIGHT TO AUDIT
During the term of this Agreement, and at any time within three (3) years following the expiration of
this Agreement, the parties shall have the right of access to all information held in the possession of the other
party related to services performed under this Agreement, for audit purposes or otherwise. The parties agree
to provide access to such information unless expressly prohibited from doing so by court or other
governmental order. Except in the event of an emergency, either party will provide thirty (30) days prior
notice of any intended audits and the need for the information. The parties agree that each will keep records
relating to the services provided hereunder for as long as required by law.

9. NOTICES
Any notice required to be given hereunder shall be given by certified mail, return receipt to the

HEARING:
SUBJECT: Authorize Execution of Agreement in the Amount of $25,000.00 with Workforce Solutions
for Tarrant County to Further the Early Childhood Matters Initiative and Adopt Appropriation
Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to enter into an Agreement in the amount of $25,000.00 with
Workforce Solutions for Tarrant County for the City to conduct specific activities to further the Early
Childhood Matters Initiative; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grant Fund by $25,000.00, from available funds.
DISCUSSION:
On October 12, 2004, the City Council approved Resolution No. 3131, accepting an Early Childhood
Community Action Plan and authorizing the creation of an Early Childhood Matters Council to help
implement the plan.
To implement goals of the Community Action Plan, Early Childhood Matters has established four
Early Childhood Resource Centers in Community Centers to support families and caregivers so they
can help children develop successfully. Two centers opened early in 2006 and two new centers
opened last November. More than 1,150 adults have participated in educational programs to date.
The Early Childhood Matters Initiative is staffed by the Community Relations Department.
Activities specified in the terms of the Agreement with Workforce Solutions include conducting
parenting sessions, marketing activities, offering non -cash incentives to attract and retain
participants, and contracting for program evaluation services. These activities will further the
implementation of the Early Childhood Matters initiative.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above
recommendations and adoption of the attached appropriation ordinance, funds will be available in the
current operating budget, as appropriated in the Grant Fund.
