A Resole On
WAIVER: U.S. DEPARTMENT OF TRANSPORTATION'S
SECTION 504 REGULATIONS
WHEREAS, there is a recognized need to provide transportation service to the
mobility impaired citizens of the Fort Worth Urbanized Area; and,
WHEREAS, the Fort Worth City Council approved a plan for meeting the
transportation needs of mobility impaired citizens on May 17, 1977
(M&C TE-163) ; and,
WHEREAS, the U.S. Department of Transportation issued final regulations,
known as Section 504 Regulations, on May 31, 1979; and,
WHEREAS, the U.S. Department of Transportation's 504 Regulations required a
Transition Plan which was considered and adopted by the Fort
Worth City Council on May 27, 1980 (M&C TE-325) ; and,
WHEREAS, implementing the requirements of the U.S. Department of
Transportation's Section 504 Regulations is non-effective in meeting
the needs of our mobility impaired citizens; and,
WHEREAS, an expressed desire of local citizens has been heard on the
continuation of the special, door-to-door Mobility Impaired
Transportation Service (MITS) ; and,
WHEREAS, Part 5.11(a) of Title 49 of the Code of Federal Regulations makes
provision for the Secretary of Transportation to grant a permanent
exemption from any rule.
NOW, THEREFORE, be it resolved by the Fort Worth City Council:
1) That the City of Fort Worth does reaffirm its commitment to
support adequate transportation service to the handicapped;
and,
2) That the City of Fort Worth believes the most efficient and
effective way of providing adequate transportation to the
handicapped is the special, door-to-door Mobility Impaired
Transportation Service; and,
3) That the City of Fort Worth does hereby go on record in
support of a permanent exemption from the U.S. Department of
Transportation's Section 504 Regulations which require fixed
route accessibility on local transit buses; and,

4) That the U.S. Department of Transportation, Office of the
Secretary, is strongly urged to grant a permanent waiver
regarding Title 49, CFR Part 27-27.85, to the Fort Worth
Urbanized Area; and,
5) That copies of this Resolution be transmitted to the Secretary
of the U.S. Department of Transportation, members of the Fort
Worth/Dallas Congressional Delegation, and the Governor of the
State of Texas; and
6) That this Resolution be in full force and effect upon its
adoption by the Fort Worth City Council.
