AR A WHEREAS, there is a recognized need to prov-de transportation service to the mobility impaired citizens of the Fort Worth urbanized area; and, WHEREAS, the Fort Worth City Council approved the plan for meeting the transportation needs of mobility impaired citizens on May 17, 1977 (M&C TE-163) ; and, WHEREAS, the U. S. Department of Transportation issued final regulations, known as the Section 504 Regulations, on May 31, 1979; and, WHEREAS, the U. S. Department of Transportation's 504 regula- tions required a transition plan which was considered and adopted by the Fort Worth City Council on May 27, 1980 (M&C TE-325) ; and, WHEREAS, implementing the requirements of the U. S. Department of Transportation, Section 504 regulations is not effective in meeting the needs of our mobility impaired citizens; and.. WHEREAS an expressed desire of local citizens has been heard on the continuation of the special door-to-door mobility impaired transportation service (MITS) ; and, WHEREAS, the City of Fort Worth has submitted a grant applica- tion to the urban Mass Transportation Administration for rehabilitation of six older buses _(TX-03-0064) ; and, WHEREAS, it would serve no useful purpose to equip these six rehabilitated buses with wheelchair lifts; and, WHEREAS, Part 5.11(a) of Title 49 of the Code of Federal Regulations makes provisions for the Secretary of Transportation to grant a permanent exemption from any rule; NOW, THEREFORE, BE IT RESOLVED by the Fort Worth City Council: 1. That the City of Fort Worth does reaffirm its commitment to support adequate transportation service to the handicapped; and, (, 2. That the City of Fort Worth believes the most efficient and effective way of providing adequate transportation to the handicapped is a special, door-to-door mobility impaired transportation service; and, cm OF FORT SORTS 3. That the City of Fort Worth does hereby go on record in support of an exemption from the U. S. Department of Transportation Section 504 regulations which required fixed route accessibility on local transit buses and, equipping rehabilitated buses with wheelchair lifts; and, 4. That the U. S. Department of Transportation, Office of the Secretary, is strongly urged to grant a waiver regarding Title 49, CFR Part 27-27.85, to the Fort Worth urbanized area on this matter; and 5. That copies of this resolution be transmitted to the Secretary of the U. S. Department of Transportation, members of the Fort Worth Dallas Congressional delegation and the Governor of the State of Texas; and, 6.
