HomeMy WebLinkAboutIR 8762T r To the Mayor and Members of the City Council SUBJECT: Transportation Impact Fees f671 TPW staff would like to take this opportunity to update the City Council on the status of development of the Transportation Impact Fee policy. Transportation Impact Fees will be the mechanism by which the City will collect developer contributions to be used for constructing regional transportation infrastructure following policy adoption later this year. Developer contributions are currently collected under the CFA, although the existing policy disregards the impact on the overall transportation network. Additionally, consideration of proportionality (i.e., the amount of infrastructure the City requires the Developer to fund/construct must be "roughly proportional," both in nature and extent, to the projected impact of the development) is not inherent to the existing policy. The proposed Transportation Impact Fees will be based on a calculation of proportional share and will, therefore, be more legally defensible in accordance with rulings from two previous Supreme Court cases dealing with developer exactions. While the new policy will comply with State and Federal proportionality requirements, it will likely not represent a large increase in the amount collected from developers for regional transportation improvements. However, impact fees will dramatically increase the City's flexibility in utilizing 6 developer contributions and will allow for the timely construction of useable segments of the arterial network. Impact fees will also enable the City to more closely track collected funds financially and geographically on a service area basis. As you recall, the City of Fort Worth will be divided into separate service areas with each service area being roughly six miles in diameter per State Law governing impact fees. A. Fort Worth's City Plan Commission is well suited to this role: • The real estate, building, and development industries are adequately represented; • All Council districts are equally represented; • As the recommending body for the City's Comprehensive Plan and Master Thoroughfare Plan, the Commission is uniquely familiar with the City's land use plan, growth assumptions, roadway plan, and the current difficulty in providing adequate infrastructure to support new development. B. The Impact Fee Policy is scheduled for adoption in late 2006. General project milestones are scheduled as follows and will include regular updates to the City Council: • Presentation of Pilot Service Area study results: May 2006 • Completion of land use documentation and capital improvement plans for all service areas: July 2006 • Completion of fee calculations for all service areas: August 2006 • Stakeholder meetings and public hearings: September /October 2006 • Fee consideration and adoption: November 2006 �" �< C. The implementation phase of the Transportation Impact Fee Policy development is scheduled to begin following policy adoption. The proposed FY 06/07 budget currently includes $250,000 for the implementation phase that includes: a. Development of a tracking mechanism for collection and expenditure of fees by service area b.
