HomeMy WebLinkAboutContract 38748WORKFORCE SOLUTIONS "kaR TARRANT COUNT" CIfiY SECRETgRy CONTRACT NO, Summer Youth Employment Program EMPLOYMENT EXPERIENCE AGREEMENT This "Agreement" sets forth the responsibilities of City of Fort Worth, Texas hereafter known as the Work Site Provider and Workforce Solutions for Tarrant County Summer Youth Employment Program, hereafter known as the Program Operator, as the means to cooperatively implement and support the Summer Youth Employment Program. This Agreement is effective June 1, 2009 through December 31, 2009 utilizing the American Recovery and Reinvestment Act federal funds. Entities authorized to execute this agreement on behalf of Workforce Solutions for Tarrant County (Board) Summer Youth Employment Program shall include service providers under contract with the Board to provide summer employment experiences. Referrals of youth to individual employment opportunities with the Work Site Provider may be made by these authorized service providers. Purpose of the Summer Youth Employment Program The purpose of the Summer Youth Employment Program is: 1. To establish work readiness programs to prepare economically disadvantaged individuals facing barriers to employment for entry into subsidized employment; and 2. To provide employment training worksites to prepare youth for entry into the labor force. General Provisions The responsibilities of this Agreement are that the Work Site Provider and the Program Operator hereby agrees to abide by the following assurances and provisions: 1. Work Site Provider shall provide to Program Operator participants all employment training, supervisory assistance, and other services as normally provided to regular agency employees. The Work Site Provider must provide adequate supervision and sufficient work hours and must ensure that sufficient equipment to perform assigned duties be available to carry out the daily assignments, including any and all safety devices necessary and any materials required. 2. Work Site Provider hereby assures Program Operator that it will adhere to requirements of the Americans with Disabilities Act of 1990; the Rehabilitation Act of 1973, Section 504; the Occupational Safety and Health Act of 1970; the Child Labor Requirements in Non -Agricultural Occupations under the Fair Labor Standards Act; the Drug Free Workplace Act of 1988; and the Non -Discrimination and Equal Opportunity Requirements. • The Work Site Provider will provide aDrug-Free Workplace policy statement to each program participant. WORTH, T)f } • Workforce participants are not allowed to work, train, or receive services in buildings, surroundings, or working conditions which are unsanitary, hazardous, or dangerous to program participant(s) health and safety. Applicable child labor laws must be observed for all 14-17 year old participants. Information on Child Labor Laws may be obtained from your local Program Operator or from the Texas Workforce Commission. 3. Work Site Provider's participation in the Summer Youth Employment Program shall not cause displacement of currently employed workers. This includes partial displacement such as reduction of wages, employment benefits, or hours ofnon-overtime work. 4. Workforce Solutions for Tarrant County Summer Youth Employment Program will not be used to employ any person to fill a job opening created by laying off or terminating the employment of any regular employee or otherwise reducing the regular workforce, in anticipation of filling vacancies by hiring participants supported under this program. 5. Maximum effort will be made to place program participants in occupational skills) training activities that offer meaningful work experience and an introduction to the World of Work focusing on areas of interest to the participant and providing work maturity skills. 6. Contingency plans for outdoor work sites, in case of inclement weather, will be required from work site supervisors. Secondary work sites must also comply with ensuring there is adequate supervision and work for program participants. 7. Program participants will not be discriminated against on the basis of race, creed, color, physical or mental disability, national origin, gender, sexual orientation, age, political affiliation, or religious belief. 8. It is understood that Workforce Network Inc., as the primary subcontractor for the Board WIA Youth Program activities, shall be the employer of record for all youth placed in employment under this Agreement. 9. Workforce Program participants are provided with Worker's Compensation insurance coverage by Program Operator. Coverage is provided to participants ONLY while officially attending work or other training activity. If and when participants are transported to and from home by Work Site Provider, in Work Site Provider's vehicles, Work Site Provider must have appropriate and adequate insurance coverage for passengers. The Program Operator and Workforce Solutions for Tarrant County will not be liable for personal and/or physical damages suffered by program participants while being transported to and from home by Work Site Provider. 10. Program participants will be provided rest periods ("Breaks") and lunch time in the same manner as they are provided to the Work Site Provider's regular employees. 11. Work Site Provider shall maintain accurate daily attendance records for each participant. Participants will only be paid for ACTUAL WORK TIME attending employment and training activities. No sick leave, holidays, lunch time, annual leave for absences or non -worked hours will be paid to the participant. 12. The Work Site Provider agrees to complete the participant's Summer Youth Employment Program payroll timesheet and submit to the Program Operator. All time sheets will be signed by the participant and the work station supervisor. 13. Equal employment opportunities will be accorded to program participants when job opening opportunities become available and/or known which require job -skill competencies comparable to those work skills/job proficiencies acquired by program participants. 14. Program participants shall be released to attend training or job referral activities upon notification or request by Program Operator. fiu"KLVV®RD Page 2 of 3 �CFFVSECRETARY f 5. Work Site Provider may not terminate a participant from the program without approval from Program Operator. Work Site Provider must report any serious or continual work site problems with participants. Work Site Provider may submit a written request to the Program Operator asking that a participant be removed or suspended from a worksite. Efforts will be made to place the participant at an alternate work station. 16. Work Site Provider will cooperate with Program Operator to fulfill the requirements set forth by the Board, Texas Workforce Commission and/or the Department of Labor in areas such as, but not limited to: a) Execution of participation applications forms and related documentation, b) Compliance with supervisor's orientations, c) Submittal of time sheets according to instructions, d) Evaluation of participants in accordance with Workforce Program forms, and e) Cooperation with Program Operator for monitoring and evaluations conducted in agency's work. 17. A copy of this signed Agreement shall be provided to all work site supervisors. 18. Participants shall not be employed in a position that supports sectarian instruction, political activities, lobbying activities or religious worship. We hereby understand and will abide by "Employment Experience Agreement" and all the General Assurances and provisions hereby incorporated by reference and made part of this Agreement.
