CITY and/or the CITY's construction contractors or other entities, and do not
relieve the construction contractors or any other entity of their obligations,
duties, and responsibilities, including, but not limited to, all construction
methods, means, techniques, sequences, and procedures necessary for
coordinating and completing all portions of the construction work in
accordance with the Contract Documents and any health or safety precautions
required by such construction work. The ENGINEER and its personnel have
no authority to exercise any control over any construction contractor or other
entity or their employees in connection with their work or any health or safety
precautions.
(2) Except to the extent of specific site visits expressly detailed and set forth in
Attachment A, the ENGINEER or its personnel shall have no obligation or
responsibility to visit the construction site to become familiar with the progress
or quality of the completed work on the PROJECT or to determine, in general,
if the work on the PROJECT is being performed in a manner indicating that the
PROJECT, when completed, will be in accordance with the Contract
Documents, nor shall anything in the Contract Documents or the agreement
between CITY and ENGINEER be construed as requiring ENGINEER to make
exhaustive or continuous on -site inspections to discover latent defects in the
work or otherwise check the quality or quantity of the work on the PROJECT.
If, for any reason, the ENGINEER should make an on -site observation(s), on
the basis of such on -site observations, if any, the ENGINEER shall endeavor
to keep the CITY informed of any deviation from the Contract Documents
coming to the actual notice of ENGINEER regarding the PROJECT.
(3) When professional certification of performance or characteristics of materials,
systems or equipment is reasonably required to perform the services set forth

CITY's actual PROJECT costs, financial aspects, economic feasibility, or
schedules will not vary from the ENGINEER's opinions, analyses,
projections, or estimates.
G. Construction Progress Payments
Recommendations by the ENGINEER to the CITY for periodic construction
progress payments to the construction contractor will be based on the
ENGINEER's knowledge, information, and belief from selective sampling and
observation that the work has progressed to the point indicated. Such
recommendations do not represent that continuous or detailed examinations
have been made by the ENGINEER to ascertain that the construction
contractor has completed the work in exact accordance with the Contract
Documents; that the final work will be acceptable in all respects; that the
ENGINEER has made an examination to ascertain how or for what purpose
the construction contractor has used the moneys paid; that title to any of the
work, materials, or equipment has passed to the CITY free and clear of liens,
claims, security interests, or encumbrances; or that there are not other matters
at issue between the CITY and the construction contractor that affect the
amount that should be paid.
Record drawings, if required, will be prepared, in part, on the basis of

Re: Rolling Hills Soccer Complex -Parking Expansion &Improvements to Fields.
Dear Joel:
I appreciate the opportunity to submit The Landscape Alliance's (TLA) proposal to provide professional
services related to the design and development of parking, new fields and related improvements at Rolling
Hills Park. It has been represented that the defined project will include a new Master Plan for the complex
along with survey and geo-tech information desired as a prerequisite to design work.
The project scope will further include:
Phase I - Survey and Base Plan
This phase will include preparation of a survey and base maps of the project area in sufficient detail to
provide adequate and accurate information on site conditions to guide design and engineering of proposed
improvements. The survey will conform to GPS standards and will overlap the previous survey along Joe
B. Rushing Road to ensure a compatible transition. The Survey area is generally described as follows: Joe
B Rushing Road to the south, the eastern edge of plan fields 5, 10 & 14 to the west, a northern edge defined
as the north property line and Wichita Street to the east.
Phase II -Master Plan
TLA will prepare an updated Master Plan of the Complex to guide currently planned and future
improvements on the site. This effort will be directed by the PACS staff and is not anticipated to include
community input. The product of this phase will be a rendered master plan of the park and
recommendations for subsequent phased development including currently funded improvements.
Phase III -Project Design and Construction Documents
The scope of proposed improvements includes new fields, grading, fencing, irrigation, turf improvements,
a group shelter, bleacher pads, walkways and related improvements based on a budget represented to be
$732,400. The project will be pursued in close cooperation with the PACSD and key staff members through
design development. Specific site elements will be confirmed, products selected and refined cost estimates

COUNCIL ACTION: Approved on 6/9/2009
DATE: Tuesday, June 09, 2009
LOG NAME: 80ROLLING HILLS TLA09
REFERENCE NO.: **C-23579
SUBJECT:
Authorize an Engineering Agreement with The Landscape Alliance in the Amount of $76,600.00 for Parking
Lot and Soccer Field Improvements at Rolling Hills Soccer Complex
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute an engineering agreement
with The Landscape Alliance in the amount of $76,600.00 for the design and preparation of construction
documents for parking lot and soccer field improvements at Rolling Hills Soccer Complex.
DISCUSSION:
The purpose of this M&C is to authorize the City Manager to execute an engineering agreement with The Landscape
Alliance for the design and preparation of construction documents for improvements consistent with the master plan
for Rolling Hills Soccer Complex.
The 2004 Capital Improvement Program (CIP) allocated $416,WWI .00 for road and parking improvements, and
$477,000.00 for athletic field improvements at Rolling Hills Soccer Complex, together totaling $893,000.00.
The Landscape Alliance, has proposed to perform design and preparation of construction documents for a lump sum
fee of $76,600.00. City staff considers this fee to be fair and reasonable for the scope of services proposed.
Construction is anticipated to begin early February 2010 and will be completed by late June 2010.
M/WBE -The Landscape Alliance is in compliance with the City M/WBE Ordinance by committing to 12 percent
M/WBE participation. The City's goal on this project is 10 percent.
Rolling Hills Soccer Complex is located in COUNCIL DISTRICT 8.
