TO CITY SECRETARY CONTRACT No.
WHEREAS, the City of Fort Worth (CITY) and Kennedy Consulting, Ltd.,
(ENGINEER) made and entered into City Secretary Contract No. 38775, the
CONTRACT) which was authorized by M&C C-23596 on the 16th day of June,
2009 in the amount of $ 1,465,379; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $ 21,154.05 which was administratively authorized on
the 29th day of November 2010, Amendment Number 2 in the amount of
$121,950.80 which was authorized by M&C # C-25348 on the 13th day of
December 2011, Amendment Number 3 in the amount of $64,400.00 which was
authorized by M&C # C-25893 on the 2'd day of October 2012, Amendment
Number 4 in the amount of $132,200.00 which was authorized by M&C # C-
26124 on the 5th day of March 2013; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Dirks Road Phase 2 from Bryant Irvin Road to Granbury Road; and
WHEREAS, it has become necessary to execute Amendment No. 5 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated July 23, 2013, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$63,017.00. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,868,100.85.

City Project No. 00768, City Secretary Contract No. 38775
Proposal to provide:
1) Revise proposed railroad retaining wall layouts, details, and affect
construction documents (plans and specifications) to reflect a proprietary T-
Wall System in lieu of a cantilever spread footing and/or drilled shaft
retaining wall system.
2) Additional plan sheet preparation, modifications, and coordination due to
revised retaining wall type.
Dear Mr. Ingram:
This letter is written in response to your request for Kennedy Consulting, Ltd. to prepare
a contract amendment for additional engineering services to amend and/or develop
additional construction documents for Dirks Road (East) due to changes to the FWWR
Railroad retaining walls from cast -in -place spread footing and drilled shaft retaining
walls to a T-Wall Retaining Wall System (proprietary wall system from The Neel
Company). The change in wall type is the result of the recent approval of a Public
Interest Finding submitted by the City of Fort Worth to the Texas Department of
Transportation (TxDOT) to allow the use of this proprietary system. TxDOT's
concurrence on this finding will allow the City to realize a significant time (reduced
construction time by 3.5 months) and cost (� M) savings on this project.
Kennedy Consulting, Ltd. will complete the following additional scope:
Additional Project Scone —Structural Layout and Details
The contract amendment shall include developing additional structural layout and details
specific to the T-Wall System for inclusion in the final plans and construction documents.
Revisions will also include miscellaneous wall details to accommodate a culvert and
utility penetrations, wall under drain details, and modified track cross sections.

Additional Project Scone — Modify Construction Plans and Specifications
The contract amendment shall also include modifying the currently developed plan sheets
and specifications to show additional information regarding the revised retaining wall
system. The following changes to the construction documents will be required:
1. Replace all references to the currently proposed retaining wall system with a T-Wall
retaining wall system.
2. Remove, update, or replace impacted plan sheets. This includes addition of new
sheets, as needed.
3. Remove, update, or replace impacted specifications and special provisions. This
includes addition of new specification and special provisions, as needed.
4. Revise construction schedule and sequence of construction based on construction of a
T-Wall system.
5. Revise quantities and engineer's cost estimate based on construction of a T-Wall
system.
Additional coordination time is also expected with the City and TxDOT to discuss review
comments and resolutions. The contract amendment shall also include additional effort
for extended coordination with the City, NTTA, TxDOT and the FWWR concerning the
revised wall system, plan modifications, Railroad Agreement preparation, TxDOT plan
submittal and delivery schedule meetings, and CIP Manager coordination.
Total Compensation
Kennedy Consulting, Ltd. proposes to provide the above mentioned services for the lump
sum amount of $63,017.00 (see attached fee proposals for additional details).

It is recommended that the City Council authorize execution of Amendment No. 5 to
City Secretary Contract No. 38775, an Engineering Agreement with Kennedy
Consulting, Ltd., in the amount of $63,017.00 for the design of Altamesa Boulevard
formerly known as Dirks Road from Bryant Irvin Road to Granbury Road, thereby
increasing the total contract amount to $1,868,100.85.

This Agreement is for the design of Altamesa Boulevard formerly known as Dirks
Road as a six lane divided principal arterial from Bryant Irvin Road to Cranbury Road.
Phase I of the Project has been completed. This Amendment applies to the design of
Phase II. This contract amendment is for additional engineering services required to
replace the currently proposed retaining wall system with a T—Wall retaining wall
system to reduce construction cost and time.
The T—Wall is a proprietary retaining wall system. Therefore, its use must be approved
by the Texas Department of Transportation (TxDOT), through a Public Interest
Finding, in accordance with the Federal Highway Administration (FHWA) funding
requirements. The T—Wall system was recently approved by TxDOT and FHWA based
on the Public Interest Finding report prepared by Staff. The report specified that the
T—Wall system best served the public's interest because it provides a construction cost
savings of $3,000,000.00, reduces construction time by 3.5 months, and is easily
constructed which creates an overall safer working environment. Funds for this
Amendment will be provided from the 2007 Critical Capital Projects Fund.

Kennedy Consulting, Ltd., proposes to complete Amendment No. 5 for a fee not to
exceed $63,017.00. Staff considers this fee to be fair and reasonable for the scope of
services proposed to be performed.
M/WBE Office: A waiver of the goal for MBE/SBE subcontracting requirements was
requested by the Department and approved by the M/WBE Office, in accordance with
the MIWBE or BDE Ordinance, because the purchase of goods or services from
source(s) where subcontracting or supplier opportunities are negligible.
This project is located in COUNCIL DISTRICT 6, Mapsco 102C and 102D.
FISCAL INFORMATION:
The Financial Management Services Director certifies that funds are available in the
current capital budget, as appropriated, of the 2007 Critical Capital Projects Fund.
