HomeMy WebLinkAboutOrdinance 24257-06-2020 Ordinance No. 24257-06-2020 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL DONATIONS CAPITAL PROJECTS FUND IN THE AMOUNT OF $10,000,00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE FWPA-EASTSIDE LIBRARY PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to-the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in Special Donations Capital Projects Fund in the amount of$10,000.00,from available funds,for the purpose of funding the FWPA-Eastside Library project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Forming mental connections has a certain vulnerability and it occurs more easily in an environment that is beautiful, immersive, and enveloping. The artist intends to use handmade colored glass spheres, laser-cut stainless steel 'lacework'wrapped around a steel armature, and networked LED lighting. The artwork will be playful while maintaining a feeling of quality, substance and value. DISCUSSION: Longtime East Fort Worth residents,Ms.Wanda Conlin and Mr.Don Boren,are true community leaders,serving on various commissions for the City of Fort Worth as well as the West Meadowbrook Neighborhood Association and the East Fort Worth Business Association.Together,they attended every public meeting for the 2014 Bond Program to advocate for a new library on East Lancaster Avenue.They were active participants in the development of the East Lancaster Corridor Public Art Master Plan by artist Jack Mackie. Ms. Conlin and Mr. Boren currently serve as Project Core Team members for the Reby Cary Youth Library Public Art Project and now wish to fulfill their generous pledge of$10,000.00 to support the fabrication of the artwork. Only Connect is an interactive,multi-faceted artwork designed by Joe O'Connell Creative Machines, Inc.specifically to engage youth ages 0—18 years old at the Reby Cary Youth Library(formerly referred to as the Eastside Family Library).Echoing connections between neurons as the brain learns,individuals within a community,and subjects within the library from art history to comics,O'Connell's immersive artwork makes the process of learning through connections an ever-evolving visual experience. On December 17,2019(M&C 19-0391), City Council authorized execution of an Artwork Commission Agreement with Joe O'Connell Creative Machines, Inc.(City Secretary Contract No.53467)in an amount of up to$300,662.36. Funding for the project has been allocated from the from the 2014 Bond Program, Proposition 3, adopted by the Fort Worth City Council on October 21,2014(M&C G-18339).Additional funding for the project was included in the Fund Reprogramming Plans from the 2007 Critical Capital Needs Program and the 2008 Bond Program,adopted by the Fort Worth City Council on June 26,2018 (M&C G-19323).The project was included in the Fort Worth Public Art Fiscal Year 2020 Annual Work Plan,adopted by the Fort Worth City Council on April 7,2020(M&C 20- 0204). Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No.21241-05-2014) and subsequent actions taken by the Mayor and Council. This project is located in COUNCIL DISTRICT 8 but serves the entire City. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
