HomeMy WebLinkAboutContract 39315-A1AMENDMENT NO. 1 TO ENGINEERING CONTRACT STATE OF TEXAS § CITY SECRETARY COUNTY OF TARRANT § Contract No. WHEREAS, the City of Fort Worth (City) and AECOM USA Group, Inc. (Engineer) made and entered into City Secretary Contract No. 39315 (the "Contract") on the 22nd day of September, 2009; and WHEREAS, the Contract involves engineering services for the following project: Como Creek Open Channel Study (Study No. SWS-010) WHEREAS, it has become necessary to amend said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, Section 1 of the Contract is amended to include the additional engineering services specified in a proposal letter and Attachment "A" dated July 21, 2010, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer is Forty Seven Thousand and Five Hundred Dollars ($47,500). 2. Article III of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of Three Hundred Eighty Three Thousand and Five Hundred Dollars ($383,500). 3. Engineer acknowledges its commitment to obtain an additional N/A M/WBE " participation for this amendment. The Engineer's commitment for the Contract remains unchanged. 4. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. 7 EXECUTED on this the �p`��' day of , 2010, in Fort Worth, Tarrant County, Texas. (AECOM) has prepared this amendment to assist the City of Fort Worth (City) in their water quality needs for management of floatable materials (debris and solid waste) in the City 9s waterways. AECOM believes that the additional scope of work outlined in Attachment "A" will provide the necessary support and on -call services to the City in this effort. Furthermore, this additional scope of work will serve a dual purpose of providing assistance to the City in its short term water quality needs while laying the framework for a long term City -Wide Water Quality Program. Gasperich, P.E., CFM Project Director ATTACHMENT "A" ADDITIONAL SERVICES FOR COMO CREEK OPEN CHANNEL STUDY STUDY NO, SWS=010 AMENDMENT TO CITY SECRETARY CONTRACT NO. 39315 In accordance with the terms and conditions of AECOM USA Group, Inc. (AECOM) Agreement (City of Fort Worth Contract No. 39315) authorized September 22, 2009, this document serves as AECOM's request for additional compensation for Additional Services related to the referenced project. I. Additional Services As part of these services, AECOM will evaluate potential storm water structural controls or structural Best Management Practices (BMP) for the management of floatable materials (debris and solid waste) for the City of Fort Worth. Potential BMPs will be tested in strategic locations of the City to evaluate the feasibility of its application throughout the City. The set up of the pilot testing will include the following tasks: 1. Identification and evaluation of potential areas to conduct the pilot study. 2. Identification of up to 35 storm water inlets, outfalls, and/or streams for the installation of the selected BMPs. 3. Coordination with the manufacturer for the installation of selected BMPs. 4. Development of standard operating procedures to measure performance of the pilot study. 5. Coordination with interested parties, including homeowner's associations, schools, and hospitals (based on location of the installation sites). 6. Preparation of technical memorandums for each site location explaining the methodology followed to select the inlets, outfalls, and/or streams for the installation of selected BMPs. 7. Development of meeting agendas and meeting minutes to track the progress of the pilot study. 8. Development of GIS files and exhibits with location of installed BMPs. Attribute tables will contain basic information of BMPs installed at each inlet, outfall, and/or stream location. 11. Exclusions and Limitations 1. Up to five (5) coordination meetings with the City are included. 2. Installation, inspection, maintenance, and monitoring of installed BMPs are not included. 3. Waste and storm water characterization activities are not included. 4. Waste handling and disposal activities are excluded. III. Proposed Basis of Compensation and Liability Compensation shall be on a lump sum percent complete basis in the amount not to exceed $47,500 (Forty Seven Thousand Five Hundred Dollars and No Cents).
