WHEREAS, the City of Fort Worth (City) and Kimley-Horn and
Associates, Inc., (Consultant) made and entered into City Secretary
Contract No. 39546, (the Contract) which was authorized by the City
Council by M&C C-23914 on the 17th day of November 2009, and
WHEREAS, the Contract involves professional services for the
following project.
Revision of the City's Construction Specification Documents.
WHEREAS, it has become necessary to execute Amendment No. 1 to said
Contract to include an increased scope of work and revised maximum fee,
NOW THEREFORE, City and Consultant, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract.
1.
Article I, of the Contract is amended to include the additional
professional services speced in M&C C-24922, adopted by the City
Council on the 24th day of May 2011, and further amplified in a proposal
letter dated May 25t', 2011, copies of which are both attached hereto
and incorporated herein. The cost to City for the additional services to
be performed by Consultant total $884,700.00.

Article II, of the Contract is amended to provide for an increase
in the maximum fee to be paid to Consultant for all work and services
performed under the Contract, as amended, so that the total fee paid by
the City for all work and services shall not exceed the sum of
$1,887,500.00.
3.
All other provisions of the Contract which are not expressly
amended herein shall remain in full force and effect.

3UBJECTs Authorize Execution of Amendment No. 1 to the Professional Services Agreement with
Kimley-Horn and Associates, Inc., for Revision of the City's Standard Construction
Specification Documents in the Amount of $884,700.00 Increasing the Total Contract
Amount to $1,887,500.00
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 in
the amount of $884,700.00 to the Professional Services Agreement with Kimley-Horn and
Associates, Inc., for revision of the City's Standard Construction Specification Documents for use on
City Projects.
DISCUSSION:
During Phase 1 of the City's Integrated Program Management initiative, the City's Standard
Construction Documents were reviewed and determined to be in need of substantial revision.
A Standard Construction Specification Task Committee, comprised of City staff and representatives
of the local engineering and construction communities, was established and has been working to
revise the standard specifications to provide a uniform set of specifications and contract documents
for use on City projects.
On November 10, 2009, staff briefed the Infrastructure and Transportation Committee (ITC) on the
need to revise the Cay's Standard Construction Documents. It was recommended that the first phase
of the project should focus on revising the City's Standard Construction Specifications. On November
17, 2009, (M&C C-23914) the City Council authorized a Professional Services Agreement in the
amount of $1,002,800.00 with Kimley-Horn and Associates, Inc., for Revision of the City's Standard
Construction Specification Documents.
The scope of services included the following:
Review and prioritization of existing specifications;
Coordination of inputs from City Staff, consultants and contractors;
Development of CSI formatted specification documents;
Stakeholder collaboration, meetings and prioritization;
Procurement and contracting requirements; and
General requirements and general notes.
It was anticipated that the development of the new standard construction documents would be
conducted in two phases with Phase 1 consisting of the scope of services listed above. Phase 1
of the project will be completed in May and the City will begin using the new standard construction
specifications in July.
The Phase 2 scope will include the updating of current City-wide details that are out -dated and do not
conform to new specifications, creation of a standard bid items list that conforms to the new
specifications, creation of a standard products list for use City wide and training for Inspectors,

Project Managers and Program Managers for document assembly and construction administration.
Staff recommends that Phase 2 of the project be conducted at this time.
On May 10, 2011, City staff and Kimley-Horn and Associates, Inc., representatives provided the ITC
a project update which included an overview of the proposed work and the associated timeline to
complete the project. The ITC concurred with staff on moving forward with the Phase 2 work.
Kimley-Horn and Associates, Inc., proposed to provide the necessary professional services for Phase
2 on an hourly basis and multiplier with a not to exceed fee of $884,700.00, Staff considers the fee to
be fair and reasonable and recommends approval.
Approval of Amendment No. 1 for the Phase 2 services will result in a total contract amount of
$118871500.00.
The Water, Aviation, Parks and Community Services and Transportation and Public Works
departments will share in funding this project.
Kimley-Horn and Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to
16 percent M/WBE participation on this Amendment No. 1.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budgets, as appropriated, of the Water and Sewer Fund, Municipal Airport Fund, General Fund, and
the Storm Water Utility Fund.

PHASE II
General Scope of Services
The ENGINEER will perform its services as an amendment to the contract titled City's Standard
Construction Specifications, dated November 30, 2009 pursuant to the requirements delineated
with ATTACHMENT "A". Services under this attachment include engineering services for
revising the CITY's Standard Construction Specifications, Details, Standard Products List, and
Standard Bid Items for the Water and Transportation and Public Works (T/PW) Departments for
use on CITY projects.
This project will consist of the following tasks:

■ Task 3 —Standard Products List
■ Task 4 —Divisions 02-49 —Technical Specifications

Task 1 Project Management and Project Status
This Task includes the creation, maintenance, status, and review of the project schedule including
the establishment of the periodic overall progress of the project. This task is based upon assumed
project duration of 12 months.
Task 1.1 Develop Initial Project Schedule
The ENGINEER shall develop a project schedule that is generally allows for the progress of the
scope and the scheduling of meetings with the CITY and the Task Team. The CITY's schedule

guidance document will not be used for this project. The ENGINEER shall provide this schedule
to CITY generally within two weeks of the Notice to Proceed. The CITY shall review the
schedule and provide comment with respect to the intent of the schedule as well as to the CITY's
ability to achieve the review times as established by the schedule. The ENGINEER shall revise
the schedule to reflect the direction of the CITY. This schedule shall be considered as a Draft
since the total number and priority of specifications, details, and notes will not be known until
completion of subsequent tasks.
Deliverables: Post baseline schedule in a format agreed to by the CITY and the ENGINEER to
project Buzzsaw site.
Task 1.2 Project Schedule Status
The ENGINEER shall update and provide a reasonable account of the progress of the project.
The ENGINEER shall update the schedule at least once per month to include changes to the
schedule.
Deliverables: Post schedule updates in a format acceptable to the CITY and the ENGINEER to
the City Buzzsaw site.
Task 1.3 Management Team Meetings
The ENGINEER shall attend Management Coordination Meetings. These meetings should occur
approximately once per week and should be a reoccurring date and time as established jointly by
the CITY and the ENGINEER. The meeting should generally include the Project Principal, and
the CITY's project manager, and any other designee as assigned by the CITY. The Meeting
should generally cover a review of the project progress as well as the status of any action items
that impacts the progress of the project.
Deliverables: There are no Deliverables for this Task
Task 2 Project Initiation
This task will include developing a Table of Contents for the CITY Standard Details, a Table of
Contents for the Standard Products List. The task will also include developing a template and
drafting standards for details, and a standard format for the Standard Products List. Following are
descriptions of each of the subtasks.
Task 2.1.1 Standard Products List Kick-off Meeting
Prepare for and attend a Kickoff meeting with designated CITY Team members to discuss overall
standard products list goals, sources of existing data, formatting options, naming conventions, and
final storage and access.
Deliverables: Post meeting notes to project Buzzsaw site
Task 2.1.2 Develop Standard Products List Standard Template

Develop a standard template to be used by the ENGINEER's Team in the creation or revision of
the City-wide Standard Products List. The template will include standard naming conventions,
designating a software platform, standard references to the Standard Technical Specifications,
and standard processes for acceptance of products.
Deliverables: Post draft template to be used by the ENGINEER'S Team to the project Buzzsaw
site.
Task 2.1.3 Develop Standard Products List Table of Contents
Develop an initial Standard Products List Table of Contents to be used for scheduling,
assignments, and tracking progress.
Deliverables: Post draft table of contents to the project Buzzsaw site.
Task 2.2.1 Standard Construction Details Kick-off Meeting
Prepare for and attend a Kickoff meeting with designated CITY Team members to discuss overall
standard construction detail goals, sources of existing data, formatting options, naming
conventions, and final storage and access.

Task 2.2.2 Develop Standard Construction Details Template

Technical Specifications.

Task 2.2.3 Develop Standard Construction Details Table of Contents
Develop an initial Standard Construction Details Table of Contents to be used for scheduling,
packet delineation, assignments, and tracking progress.

Tanks 2.3.1 Project Buzzsaw Initiation
Modify the current project Buzzsaw site to store and distribute the material produced by this
scope of services. Add project team members, and set initial permissions and access rights for all
CITY and ENGINEER team members. Add additional structure for standard bid item list,
additional technical specifications, stand construction details, and standard products list.

Task 3 Standard Products List
Task 3.1 Kick-off Meetings
Conduct a series %J kick-off meetings with a focus on Water, Wastewater, Storm Water,
Transportation, and Traffic to review goals, format, data sources, schedules, procedures for
approval, and product research to be performed as part of assembling the City-wide Standard
Products List.
Deliverables: Post Meeting Notes to the project Buzzsaw site
Task 3.2 Data Collection
The CITY shall assist the ENGINEER in obtaining all current standard products list, letters of
acceptance to the standard products list and a list of products typically used for those work types
that do not currently have a standard products list.
Deliverables: None
Task 3.4 Develop Draft Standard Products List
The ENGINEER shall develop a draft Standard Products list in accordance with the current
Standard Products List and the direction provided in the Kick-off Meeting, to include the intent of
the technical specifications, as well as any research directed by the City. Standards Products List
will be formatted in accordance with Task 2 and shall be numbered in such a way that there is a
direct link to the Technical Specifications.
Deliverables: Post draft standard products list to the project Buzzsaw site
Task 3.5 City Review Meetings
Conduct a series of review meetings with a focus on Water, Storm Water, Transportation, and
Traffic to review the draft standard products list created in Task 3.4. The ENGINEER will note
comments from the CITY and revise the Standard Products List as necessary.
Deliverables: Post draft standard products list to the project Buzzsaw site
Task 3.6 Discretionary Product Research
Investigate products as directed by the CITY. The investigations will be limited to product
availability, their use and report performance with other municipalities in the area, and their
compliance with the intent of the technical specifications.
Deliverables: Post data, exhibits, or other prepared documents to the project Buzzsaw site.

Task 4 Divisions UZ-49 — Technical Specifications
The ENGINEER shall establish multiple production teams that review, update, and convert the
specification according to format established in the original contract. It is the intent that the
teams be arranged that multiple specifications can be completed in parallel. A list of Division 02-
49 specifications in CSI M1704 format will be developed for consideration by the CITY. It is
anticipated that this phase will include three (3) water, three (3) wastewater, and three (3) TPW
related specifications.
Task 4.1 Kick-off Meetings to Receive City's Comments on Existing Specifications
Conduct a series of meetings with each of the CITY's impacted departments to receive input from
representative personnel from that department. The meeting will include the appropriate
members of the ENGINEER's team, as well as the CITY's personnel. Meetings should generally
be representative of the quantity and complexity of specifications to be reviewed, updated and
revised for that Department.
Task 4.2 Draft Technical Specifications
Prepare draft specifications in accordance with format as provided and the information gathered
in Tasks 4.1 In general, the specification should incorporate nationally recognized standards, or
regionally recognized standards for references. The review, update, and conversion of the
specifications will use products and standards that are already acceptable to the CITY. Only in
instances where the existing standard refers to a product or a process that is no longer available,
shall the ENGINEER change the acceptable product or process approved by the City.
Specifications and/or details will be completed on a per Packet basis.
Deliverables: Post draft specifications for Divisions 02-49 to the project Buzzsaw site.
Task 4.3 CITY Meetings to Review Draft Technical Specifications
Conduct a series of meetings with each of the CITY's impacted Departments to receive input
from with respect to the intent of the specification. The meeting may include the appropriate
members of the ENGINEER's team. Meetings should generally be representative of the quantity
and complexity of specifications to be reviewed, updated, and revised for that Department.
Task 4.4 Task Team Meetings to Review Draft Technical Specifications
Conduct a series of meetings with Task Team to receive input from the contracting community
with respect to the intent of the specification. The meeting may include the appropriate members
of the ENGINEER's team, the Task Team, as well as impacted City departments. Meetings
should generally be representative of the quantity and complexity of specifications to be
reviewed, updated, and revised for that Department.
Task 4.5 Technical Specifications Format Review
Conduct a format review to the specifications format with CSI MF04.
Task 4.6 Finalize Technical Specifications

Revise specifications to address the CITY review, the Task Team review, and the Format review.
Also revise specifications based on any additional written comments received from the Task
Team or the City.
Deliverables: Post draft specifications for Divisions 02-49 to the project Buzzsaw site.
Task 5 Standard Construction Details
The ENGINEER shall establish multiple production teams that review, update, and convert the

Prepare draft details in accordance with format as provided and the information gathered in Tasks

Task 6 Standard Bid Item List
Task 6.1 Kick-off Meetings
Conduct a series of kick-off meetings with a focus on Water, Wastewater, Storm Water,
Transportation, and Traffic to review goals, format, data sources, schedules, and procedures
adding as part of assembling the City-wide Standard Bid Item List.
Deliverables: Post Meeting Notes to the project Buzzsaw site
Task 6.2 Data Collection
The CITY shall assist the ENGINEER in obtaining all current Standard Bid Item lists, and sample
bidding documents for annual miscellaneous contracts.
Deliverables: None
Task 6.3 Develop Draft Standard Bid Item List
Develop a draft Standard Bid Item List in accordance with the direction provided in the Kick-off
Meeting, to include the intent of the technical specifications. Standards Bid Item List will be
formatted in accordance with Task 2 and shall be numbered in such a way that there is a direct
link to the Technical Specifications.
Deliverables: Post draft Standard Bid Items List to the project Buzzsaw site
Task 6.4 City Review Meetings
Conduct a series of review meetings with the CITY with a focus on Water, Wastewater, Storm
Water, Transportation, and Traffic to review the draft Standard Bid Item List. The ENGINEER
will note comments from the CITY and revise the Standard Bid Item List as necessary.
Deliverables: Post draft Standard Bid Items List to the project Buzzsaw site
Task 6.4 Task Team Review Meetings
Conduct a series of review meetings with the Task Team with a focus on Water, Wastewater,
Storm Water, Transportation, and Traffic to review the draft Standard Bid Item list. The
ENGINEER will note comments from the CITY and revise the Standard Bid Item List as
necessary.

Deliverables: Post draft Standard Bid Items List to the project Buzzsaw site
as 7 Training and Implementation
ENGINEER will prepare and provide training materials and conduct training sessions related to
use of the documents. Some of the training and implementation support that will be provided will
include recommendations for maintenance of the documents, establishment of a Specification
Task Team, and a process for revising, updating and notifying stakeholders of updates to the
Standard Specifications and Details. Additionally, the ENGINEER will prepare training
materials consisting of a User's Manual outlined for training sessions for internal and external
stakeholders. Descriptions of the tasks to be completed are discussed in the following
subsections.
Task 7.1 Roll -out Training
Prepare and present training materials and in multiple sessions demonstrating: how the standards
and details were developed; why CSI; where documents are stored and how to access them;
general layout of documents; how the documents should be assembled for a project; and how
documents are modified for a project specific issue. Conduct three (3) internal training sessions
to the City and two (2) external tramings sessions to contractors and consultants.
Deliverables: Workshop agenda and handout materials, workshop notes.
Task 7.2 Assembling Bidding Documents Training
Prepare and training materials and present in multiple sessions demonstrating how to assemble
Invitation to Bidders, Instructions to Bidders, preparing the Bid Form, Surety, the Agreement, and
Prequalification's. Conduct two (2) internal training sessions to the City and one (1) external
trainings sessions to contractors and consultants.
Deliverables: Workshop agenda and handout materials, workshop notes.
Task 7.3 Construction Contract Administration Training
Prepare training materials and present in multiple sessions demonstrating how the new General
Conditions and Supplemental Conditions and Division O1 impact construction contract
administration. Conduct three (3) internal training sessions to the City.
Deliverables: Workshop agenda and handout materials, workshop notes
Task 7.4 Division 0249 Technical Specifications Training
Prepare training materials and present in multiple sessions demonstrating the new technical
specifications. This will focus on how to prepare the technical specifications which have
significantly changed during the update. Conduct three (3) internal training sessions to the City.

ATTACHMENT "B"
Compensation
I. Professional Engineering Services
For all professional additional engineering services included Amendment as described in
ATTACHMENT "A", Section I, Basic Services of the General Scope of Services, the CITY
agrees to pay the ENGINEER on a cost plus maximum basis. The total amount of the
contract will not be exceeded without a modification to this agreement; however, any task
may be exceeded as long as the PROJECT total is not exceeded. Recommend budgets are as
follows:

The CITY will compensate the ENGINEER for the various items listed above on a
reimbursable basis, where the total contract amount may not be exceeded without an
amendment. Individual task budgets may be exceeded and do not represent that the entire
scope of service shall be complete for the budgets listed. Labor fee will be billed at
multiplier of 3.3 times the salary cost. Direct reimbursable expenses such as express delivery
services, fees, air travel, subconsultant expenses, printing, and other direct expenses will be
billed at 1.10 times cost. Other expenses such as in-house duplicating, local mileage,
telephone calls, facsimiles, postage, word processing and technical use of computers shall be
included as part of the labor rate multiplier. Administrative time related to the project may be
billed hourly. All permitting, application, and similar project fees that are not identified
specifically in the scope of services shall be paid directly by the Client.
Fees will be invoiced monthly based on the actual amount of service performed and expenses
incurred. Payment will be due within 25 days of your receipt of the invoice
