TO CITY SECRETARY CONTRACT No. 39460
WHEREAS, the City of Fort Worth (CITY) and Brown or Gay Engineers,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 39460,
(the CONTRACT) which was authorized by M&C(C-23866) on the 20th day of
October, 2009 in the amount of $ 241,287.00, and
WHEREAS, the CONTRACT was subsequently revised by Amendment
Number 1 in the amount of $20,390.00 which was administratively
authorized on June 24, 2011; and
WHEREAS, the
following project.

01364, and
CONTRACT involves engineering services for the
Storm Drain Structural Rehabilitation, Project No.
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated April 8, 2014, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$48,240.00. (See Attached Funding Breakdown Sheet, Page -3-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $309,917.00.

Dear Mr. Owen:
Brown &Gay Engineers, Inc. (BGE) proposes a contract amendment to add engineering design services
not included in the original contract scope. The additional design includes the following: develop site
specific manhole details for access to the existing storm drain in Lipscomb Street, develop technical
specifications for in -situ rehabilitation of storm drains, perform performance based bid phase services for
10"' Street to ensure in -situ method meets design requirements, revise construction plans previously
developed for Lipscomb Street from open cut construction to in -situ rehabilitation, prepare as -built
drawings at the completion of the construction projects.
These additional services identified in this amendment related to itu rehabilitation were unforeseen as
the project scope was originally developed to be open cut construction as recommended in the Henderson
Street Storm Drain Watershed Planning Study (CP No. 00078). The opinion of probable construction
cost for open cut construction was $2.5 million. The anticipated opinion of probable construction cost for
the in -situ rehabilitation is approximately $1.4 million. The decision to change the scope of the
construction from open cut to in -situ rehabilitation provided value to the City by reducing the capital cost,
reducing the impact to adjacent utilities, and reducing the impact to traffic operations in the central
business district. The proposed additional services are described in greater detail in the following sections
with proposed fees summarized in Attachment A.
DevelopSite Specific Manhole Details for Access To The Existing Storm Drain In Lipscomb Street
Scope includes developing site specific structural design of manhole detail for construction over the
existing 66"x72" arch pipe in Lipscomb Street. Scope includes coordination with the Storm Water
Maintenance team to design a manhole that is structurally sound but will not damage the arch pipe
constructed in the I920's. This detail will be signed and sealed by a professional engineer licensed in the
State of Texas.

Develop Technical Specifications for In -Situ Rehabilitation of Storm Drains
BGE proposes to develop up to three technical speciftcations for in -situ rehabilitation. Proposed technical
specifications include Spiral Wound PVC Liner Pipe, Structural Geopolymer Lining, and Cured in Place
Pipe (CIPP)-Non-Circular Storm Drains. A reprofiling specification is proposed for this project to
prepare the pipe for whichever method of in -situ rehabilitation is installed.
The technical specifications are proposed to establish performance requirements requiring contractors to
meet the City's criteria including (1) 50-year design life, (2) No reduction in capacity, and (3) In -situ
installation.
Perform Performance Based Bid Phase Services For loth Street to Ensure In -Situ Method Meets Design
Requirements
The proposed performance based bid services will include prequalification of contractors and in -situ
methods. BGE will review the prequalification documents submitted by all contractors. These documents
will include financial reports, history of similar work performed including applicability to the proposed
projects, resumes of key personnel, and past performance. BGE will recommend contractors for
prequalification. Contractors may submit for prequalification of different in -situ installation methods. In
that case, BGE will recommend prequalification for each method they submit.
BGE will review the prequalification documents submitted by all contractors and/or suppliers regarding
the in -situ structural rehabilitation method they propose. BGE will recommend methods for approval
based on engineering judgment of their abilities to meet the criteria set forth in the technical
specifications.
Revise Construction Plans Previously Developed for Lipscomb Street from Onen Cut Construction to In -
Situ Rehabilitation
BGE will revise the 600Adesign plans for Lipscomb Street from remove &replace to in -situ repair. The
in -situ repair will include plan and profiles for the removal of multiple water and sanitary sewer lines
crossing through the storm drain.
Prepare As -Built Drawings at the Completion of the Construction Proiects
BGE will prepare as -built drawings based on inspector and contractor mark-ups during construction for
each project.
In accordance with our contract, Article V, Section K of the STANDARD AGREEMENT FOR
ENGINEERING SERVICES, Brown &Gay Engineers, Inc., requests an equitable adjustment to our
contract to account for the additional cost required to perform the City's requested additional services.
Attachment A summarizes the proposed man hour breakdown for the additional services. The proposed
$48,240 lump sum fee for these services was determined based on the time estimated to complete at the

hourly rates outlined in Exhibit B-2, Hourly Rate Schedule from the STANDARD AGREEMENT FOR
ENGINEERING SERVICES.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 2 to City Secretary
Contract No. 39460, an Engineering Agreement with Brown &Gay Engineers, Inc., in the amount of
$48,240.00 for additional engineering design of the West Downtown Storm Drain Structural Rehabilitation
project, thereby revising the total contract amount to $309,917.00.
DISCUSSION:
The Amendment recommended by this Mayor and Council Communication will provide additional
engineering services not included in the original contract scope of work. Brown &Gay Engineers, Inc.,
identified during its analysis that the best course of action is to perform trenchless rehabilitation, rather
than open cut, thus saving construction costs and minimizing disruption. The additional services include:
development of revised technical and performance specifications and record drawings.
