' STATE OF TEXAS S CITY SECRETARY CONTRACT NO.� (No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Brown & Gay Engineers, Inc., (Engineer) made and entered into City Secretary Contract No. 39460, (the Contract) which was authorized by the City Council by M&C C-23866 on the 20th day of October 2009, and WHEREAS, the Contract involves engineering services for the following project. West Downtown Storm Drain Structural Rehabilitation Project, Project No. 01364 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract. 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated May 18, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $20,390.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $261,677.00 FT. (BGE) proposes that the 2D InfoWorks modeling scenarios be performed by BGE. We have identified the additional scope items necessary to complete this project. The additional work includes basic engineering services for Modeling, Reporting and Data Collection as identified below: Part A1—Additional Modeling a. Obtain existing conditions 2D InfoWorks model of the Henderson St. (West Downtown) Storm Drain System from Halff Associates. Upon the City's request to Halff Associates to release the model to BGE, it will be assumed by BGE that the City agrees with and accepts the model (and its results) as it is delivered to BGE. This includes model methodology, hydrologic parameters, hydraulic parameters, elevations, 2D meshes, results, other model components or results, etc. As such, BGE will accept the model as it is delivered and will not validate the delivered model or its results. Tliis model will be edited only for the scenarios discussed below. b. Review Model c. Model Scenarios (3) 1. Existing condition model with only the recommended improvements planned for C1N and L18. 2. Proposed Condition model of CIN and L18 improvements if in -situ methods are used for rehabilitation. 3. Proposed Condition model of L18 improvements if in -situ methods are used for rehabilitation upstream and downstream of Radiology Associates with upstream detention. d. EST CCTV inspection services on line L-18 upstream of Radiology Associates. In accordance with our contract, Article V, Section IC of the STANDARD AGREEMENT FOR ENGINEERING SERVICES, Brown & Gay Engineers, Inc., requests an equitable adjustment to our contract to account for the additional cost required to perform the City's requested additional services. The proposed man hour breakdown for the additional services is attached. The proposed $20,390.00 lump sum fee for these services was determined based on the time estimated to complete at the hourly rates outlined in Exhibit B-2, Hourly Rate Schedule from the STANDARD AGREEMENT FOR ENGINEERING SERVICES. This includes $4,750 for M/WBE sub consultants resulting in approximately 23% M/WBE participation for this amendment. Krogness, PE Project Manager Attachments Attachment A — Amendment No. 01 SCOPE OF SERVICES DESIGN SERVICES: SWU PROJECT - DRAINAGE IMPROVEMENTS West Downtown Storm Drain Structural Rehabilitation City Project No. 01364 The following is tasks will be performed by the ENGINEER under ATTACHMENT "A". Work under this attachment includes engineering services for paving and/or storm drain improvements for the following: 10th Street. (Cherry Street to Lexington Street) Lipscomb Street (Pennsylvania Ave to Broadway Ave) Upon receipt of notice to proceed, the ENGINEER will perform the following tasks: Part Al -Additional Modeling a. Obtain existing conditions model of the Henderson St. (West Downtown) Storm Drain System from Halff Associates. This model is to be used as a "base" model for editing in evaluation of the various scenarios described below. This model will also be used as a base line for comparison to results produced by modeling the scenarios outlined below. These comparisons will assume that model results produced by the existing conditions model obtained from Halff & Associates have been deemed true, correct, or otherwise acceptable by the CITY and will be considered by the ENGINEER to be true and correct. This also assumes that items such as model hydrology, hydraulics, methods, surface elevations, hydraulic parameters, hydrologic parameters, etc. have been accepted by the CITY and will be accepted by the ENGINEER. As such, the ENGINEER will provide no further validation of this model. b. Review Model Examine the existing conditions mode! obtained from Haiff Associates in order to get familiar with the model set up, parameters and determine key locations or elements to draw data from for comparison. c. Model Scenarios (3) ENGINEER will evaluate three (3) different scenarios in InfoWorks by editing the existing model received from Halff Associates. The scenarios included will be as follows: May 18, 2011 1. Existing condition :model with only the recommended improvements planned for C1N and L18. This model would reflect the immediate benefit in the vicinity of C1 N and L18 and Amendment No. 01 Attachment A 2. impacts to the rest of the system prior to full implementation of the master plan. It would allow the City to compare the level of protection provided to Radiology Associates before and after proposed improvements. 3. Pro used Condition model of C1 N and L18 improvements if in -situ me#hods are used for rehabilitation. This would provide data to compare the difference in flood protection between open cut and in -situ methods of reconstruction. 4. Proposed Condition model of L18 improvements if in-si#u methods are used for rehabilitation upstream and downstream of Radiology Associates with upstream detention. This is to determine the viability of in -situ rehabilitation of the structurally deficient lines upstream and downstream of Radiology Associates and identify the amount of storage required to provide greater flood protection. d. Analyze, Interpret, and Summarize Results Confirm results, make suggestions if results are not as anticpa#ed, create comparison tables to draw conclusions from, interpret and summarize results in writing. e. Technical Memorandum Write memo stating assumptions, methodology, results, findings, and recommendations. Part A2 -Data Collection a. May 18, 2091 Amendment No. 01 Attachmen# A 2of2 ATTACHMENT B — Amendment No. 01 COMPENSATION AND SCHEDULE Design Services for West Downtown Storm Drain Structural Rehabilitation City Project No. 01364 1. Compensation A. The ENGINEER shall be compensated a total lump sum fee of $20,390.00 as summarized in Exhibit "13-2" Payment of the total lump sum fee shall be considered full compensation for the services described in Attachment A for all labor materials, supplies, and equipment necessary to complete the project. B. The ENGINEER shall be paid monthly payments as described in Exhibit B-1 Section 1 - Method of Payment. Each invoice is to be verified as to its accuracy and compliance with the terms of this contract by an officer of the ENGINEER. il. Schedule Completed Technical Memo summarizing the findings of the modeling effort will be submitted within 60 calendar days after the receipt of the model from HOT Associates. May 18, 2011 Amendment (Vo, 01 Attachment B EXHIBIT 0-1 —Amendment No. 01 METHOD OF PAYMENT (Supplement to Attachment B) Design Services for West Downtown Storm Drain Structural Rehabilitation City Project No. 01364 I. Method of Payment Partial payment shall be made to the ENGINEER monthly upon City's approval of an invoice from the ENGINEER outlining the estimated current percent complete of the total project. The aggregate of such monthly partial fee payments shall not exceed the follovving; Until satisfactory completion of Conceptual Engineering plan submittal and approval by the City, a sum not to exceed 30 percent of the total lump sum fee less surveying and construction services. Until satisfactory completion of Preliminary Construction Plan submittal and approval by the City, a sum not to exceed 60 percent of the total lump sum fee, less previous payments and less surveying and construction services. Until satisfactory completion of Final Construction plan submittal and approval by the City, a sum not to exceed 90 percent of the total lump sum fee, less previous payments and less surveying and construction services. The balance of the earnings, less previous payments and less surveying and construction services, shall be payable after Bid opening for the Project has been conducted. Surveying and construction services shall be paid after services are rendered. I1. Progress Reports A. The ENGINEER shall submit to the designated representative of the Director of the Department of Transportation and Public Warks monthly progress reporfs covering all phases of design In the format required by the City.
