WHEREAS there has heretofore been granted to the State of Texas a
drainage easement being all of the land described as Tract 2 containing
0.529 acres as recorded in Volume 2446, Page 586, Deed Records , Tarrant
County, Texas ; and
WHEREAS this drainage easement is located on property held in
fee by Ridgmar Associates, a limited partnership; and
WHEREAS this property located in the northeast quadrant of the
intersection of State Highway 183 and Interstate Highway 30 is presently
being developed as the Ridgmar Mall; and
,NOW WHEREAS improvements being constructed obviate the further need
for the drainage easement; and
WHEREAS the land is no longer needed for the use of the citizens
as a road; and
WHEREAS the City of Fort Worth will assume full responsibility
to the State for the proper maintenance and adequate discharge of all
drainage in the channel located on the surplus easement;
NOW THEREFORE be it resolved by the City Council of the City of
Fort Worth;
Section I. That the Texas Highway Commission is requested to vacate
and quit claim the State's interest in the aforementioned easement to
~' Ridgmar Associates, a limited partnership, the owner of the fee in the
abutting land.
Section II. That this resolution shall become effective from and
after the date of its passage as in the charter in such cases is made
