ORDINANCE NO.
AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING
FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE
CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF
CERTAIN TERRITORY CONSISTING OF 0.012 SQUARE MILES
OF LAND, WHICH TERRITORY LIES ADJACENT TO AND ADJOINS
THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH,
TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR
ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABI-
TANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL
CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT
HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUM-
ULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT;
PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE
DATE.
WHEREAS, a petition has been signed by all of the owners of the land
described herein requesting the annexation of such territory by the City of
Fort Worth, Texas, and said petition has been filed with the City Secretary;
and
WHEREAS, the required proof of posting and publication has been
filed with the City Secretary; and
WHEREAS, an affidavit stating the total number of voters residing
in the territory and the approximate acreage within the territory has been
filed with the City Secretary; and
WHEREAS, a public hearing before the City Council of the City of
Fort Worth, Texas, wherein all interested persons were provided with an op-
portunity to be heard on the proposed annexation of the territory hereinafter
described, was held in the City Council Charmer in the City Hall of Fort Worth,
Texas, on the 26th day of January, 1970; which date is not more than twenty
(20) nor less than ten (10) days prior to the institution of annexation pro-
ceedings; and
WHEREAS, notice of such public hearing was published prior thereto
in a newspaper having general circulation in the City of Fort Worth, Texas,
and in the hereinafter described territory on the 14th day of January, 1970,
which date was not more than twenty (20) and not less than ten (10) days
prior to the date of the opening of such public hearing; and
WHEREAS, the population of the City of Fort Worth, Texas, is in
excess of 400,000 inhabitants; and
WHEREAS, the corporate area of the City of Fort Worth, Texas, was
211.786 square miles on the 1st day of January, 1970; and
WHEREAS, the hereinafter described territory lies within the ex-
clusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory contains approximately
0.012 square miles of land; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
SECTION I
THAT the following described land and territory lying adjacent to
and adjoining the City of Fort Worth, Texas, is hereby added to and annexed
to the City of Fort Worth, Texas, and said territory hereinafter described
shall hereafter be included within the boundary limits of the City of Fort
Worth, Texas, and the boundary limits of said City, at the various points
contiguous to the area hereinafter described, are altered and amended so as
to include said area within the corporate limits of the City of Fort Worth,
Texas, to wit:
ALL that certain tract or parcel of land out of the A. F. Albright Survey,
Abstract No. 1849, in the County of Tarrant, State of Texas, being a part
of that 112.3 acre tract of land conveyed to Terminal Building Corporation
of Texas by Frank C. Beall, et al, by deed dated February 25, 1950, recorded
in Volume 2169, at Page 16, Deed Records of Tarrant County, Texas, more
particularly described as follows:
FROM a concrete monument marked TESCO, in the westerly right -of -way line of
U. S. Highway No. 81, said point being the southeasterly corner of said
112.3 acre tract acquired by Terminal Building Corporation of Texas from the
Fanny G. Beall Estate, North 100 15' West, along said westerly right -of -way
line of U. S. Highway No. 81, which is also the easterly line of said 112.3
acre tract, a distance of 1091.2 feet to the POINT OF BEGINNING:
THENCE, continuing north 100 15' West, along said westerly right -of -way line
of U.S. Highway No. 81 a distance of 928.0 feet to the beginning of a curve
to the left;
THENCE, northwesterly along said curve to the left having a radius of 5669.65
feet, and along said westerly right -of -way line of U.S. Highway No. 81 a
distance of 72.0 feet to a point for corner, said point being 399.7 feet
southeasterly as measured along said westerly right -of -way line of U.S.
Highway No. 81 from its intersection with the southerly right -of -way line
of an 80.0 foot wide County road;

THENCE, South 790 45' West a distance of 246.0 feet to a point for corner;
THENCE, southerly along a curve to the left having a radius of 379.0 feet,
a distance of 110.0 feet to a point for corner;
THENCE, North 830 37' 48" West a distance of 41.5 feet to a point for corner;
THENCE, southerly along a curve to the left having a radius of 420.70 feet,
a distance of 122.0 feet;
THENCE, South 100 15' East parallel to and 350.0 feet westerly from said
westerly right of way line of U. S. Highway No. 81 a distance of 792.1 feet
to a point for corner;
THENCE, North 790 45' East a distance of 350.0 feet to the point of beginning
and containing 7.82 acres or 0.012 square mile.
SECTION II
THAT the above described territory and the area annexed shall be a
part of the City of Fort Worth, Texas, and the property so added hereby shall
bear its pro rata part of the taxes levied by the City of Fort Worth, Texas,
and the inhabitants thereof shall be entitled to all of the rights and priv-
ileges of all the citizens and shall be bound by the acts, ordinances, reso-
lutions and regulations of the City of Fort Worth, Texas.
SECTION III
THAT this ordinance shall and does hereby amend every prior ordinance
in conflict herewith, but as to all other ordinances or sections of ordinances
not in conflict herewith this ordinance shall be and is hereby made cumulative.
SECTION IV
THAT it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared void, ineffective, or unconstitutional by
the valid judgment or final decree of a court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections hereof, since the same would have been
enacted by the City Council without the incorporation herein of any such
void, ineffective or unconstitutional phrase, clause, sentence, paragraph or
section.

SECTION V
THAT this ordinance shall be in full force and effect from and after
the date of its passage on first reading and publication and its passage on
second reading as provided for in Section 40 of Chapter XXVIII of the Charter
of the City of Fort Worth and it is so ordained.
