R E S 0 L U T I 0 N RESOLUTION FILE NO.
WHEREAS, the 64th Legislative Session of the State of
Texas will be considering H. B. 1463, a bill proposing sweeping
changes in the administration of property tax assessment pro-
cedures of all tax entities in the State of Texas; and ,
WHEREAS, although many of the changes proposed in H. B.
1463 have merit, certain proposed changes, as indicated below,
fail to achieve the stated purpose of such bill by creating
difficulty in the equitable and fair assessment of property
taxes in the State of Texas; and,
WHEREAS, Article 7176b of such proposed legislation
divests home-rule cities of local control over tax assessing
by placing the administration and enforcement of all assess-
ment practices within the State in the hands of a director
appointed by the State Comptroller; and,
WHEREAS, Article 7176c of such proposed legislation
provides for the elected County Assessor to be the Chief
Administrative Officer of the County Apprisal Office; and,
WHEREAS, Article 7176c of such proposed legislation
fails to determine a city' s proportionate share of the cost
of financing the County Appraisal Office; and,
WHEREAS, Article 7176d of such proposed legislation
establishes dual tax assessment review boards and thereby
potentially creates dual assessments within a county; and,
WHEREAS, Article 7176e of such proposed legislation,
lacking consideration of the financial conditions and needs
of the individual taxing entities, restricts the total dollar
amount of property taxes imposed during the first year of
operation of said legislation to the total dollar amount of
property taxes imposed in the previous year ; and,
WHEREAS, Article 7176g as proposed provides insufficient
time for the proper implementation of H.B. 1463, if same were
to be passed :
NOW, THEREFORE, BE IT RESOLVED, that the Fort Worth City
Council expresses its firm opposition to H.B. 1463 as presently
proposed by the Legislature of the State of Texas ; and,
BE IT FURTHER RESOLVED that the Legislature of the
State of Texas be requested to reconsider H.B . 1463 in light
of the above and foregoing.
