Ordinance 17666-07-2007
ORDINANCE NO. 17666-07-2007 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO. 13896, AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF- STREET PARHING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICTS AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS"; PROVIDING FOR INTERPRETATION, PURPOSE AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION AND NAMING AN EFFECTIVE DATE. BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: ZC-07-028 3400 Block of Galvez Zoning Cltange: From: "J" Medium Industrial To: "A-5" One Family Residential Description: North 90' Lot 1, South 50' Lot 1, and Lots 2, 3, 4, 5 and 6, Block 44, Riverside Addition ZC-07-123 1112, 1116,1126, & 1130 South Adams Zoning Change: From: "PD-646" Planned Development "MU-1 "Low Intensity Mixed Use with additional devetopment standards: To: Amend "PD-646" Planned Development for "MU-I "Low Intensity Mixed Use with additional standards: Site plan approved. (SP-07--038) ZC-07-123 Continued The Oleander Place Townhomes will conform to the layout shown on the attached site plan, which includes the following three deviations from the existing Oleander Walk PD District: 1. Maximum units per acre -The project will include 17 attached townhouse units on 0.565 acres, equivalent to a residential density of 30 units per acre. This density exceeds the Oleander Walk PD's townhouse limit of 24 units per acre. The proposed density, however, is far below the Oleander Walk PD's residential density limits of 40 and 60 units per acre for single-use multifamily and mixed-use multifamily, respectively. 2. Rear yard setback - In order to provide an additional five feet for the existing rear alley, the site plan does not provide a rear setback of 5 feet. Because of this alley dedication, however, the proposed waiver of the setback requirement does not shift the buildings any closer to the adjacent property across the alley. 3. Building height -The proposed three-story townhouses will be designed and marketed as mixed-use "live/work" units, therefore conforming to the Oleander Walk PD's three-story building height limit for mixed-use projects. In order to allow flexibility for the future conversion of one or more units to single-use residential, the developers request that the proposed Oleander Place PD apply a height limit of three stores for all permitted uses.
