HomeMy WebLinkAboutResolution 335 RESOLUTION FILE NO.�.�� � R E S O L U T I O N A RESOLUTION ENCOURAGING A ONE-YEAR LIMIT ON DISCIPLINARY ACTION WHEREAS, City of Fort Worth personnel practices in the Police and Fire Departments are governed by the Texas Civil Service Statute known as the Policemen's and Firemen's Civil Service; and WHEREAS, provisions of this state law preclude the Chief of both depart- ments from taking disciplinary action for any act which may have occurred more than six months prior to any date of suspension by the Chief; and WHEREAS, the City Council of the City of Fort Worth appointed a Special Investigating Committee to investigate certain activities within the Police Department; and WHEREAS, the Committee, after lengthy hearings and investigations concluded that this provision of the statute had an adverse effect upon the effective- ness of the Chief of Police in administering the Department; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: -' That this body encourages the amendment by the Legislature of the State of Texas of the Texas Civil Service Law to provide as follows: "The Chief of Police should have the right to initiate proceedings against an officer within one (1) year of (i) : the alleged act, or (ii): the date the Chief first became aware (or should have become aware) of the act, or (iii) : the date upon which the Chief shall first be able to reveal the entire facts of these case pending as an investigation." ��iG
