SQL WHEREAS, the State of Texas did authorize a vote of the people on an amendment to the Texas Constitution permitting the exemption of not less than $3,000 of the assessed value of resident homesteads of persons sixty- five years of age or older; and, WHEREAS, such amendment was voted on by the electorate of the State of Texas on November 7, 1972; and, WHEREAS, the required Constitutional amendment was duly adopted by the residents of the State of Texas and carried by a large majority in the City of Fort Worth: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION I. That pursuant to Article VIII, Section I-b of the Texas Constitution, $4,000 of the assessed value of resident homesteads of persons sixty-five years of age or older, shall be exempt from City ad valorem taxes when taxes are levied for the year 1976, and all subsequent levies, as approved by the Council, upon the owners' compliance with the following requirements: a) That the resident owner of the homestead shall be sixty-five years of age or older as of January 1, of the tax year; b) That the resident owner of the homestead shall submit to the Tax Assessor-Collector for the City before April 30, 1976, and before each April 30th of subsequent years, an affidavit accompanied by adequate proof that the owner of the property in question is sixty-five years of age or older; c) Such other lawful qualifications as may be included in the tax levy ordinance. SECTION II. That any person who makes a false affidavit in claiming a homestead exemption shall be subject to all interest charges which accrue for lack of payment of taxes, and all other appropriate criminal penalties. SECTION III. That this resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Fort Worth and it is accordingly so ordered.
