Tarrant County ("COUNTY") and the City of Fort Worth ("CITY") entered into an Agreement located in Tarrant County Commissioners Court Order No. 107821, for the cooperative funding of improvements to Dirks Road ("Project") as described in the 2006 Tarrant County Bond Program. 2. The Project is not complete and the COUNTY and the CITY desire to renew the Agreement for the 2011 Fiscal Year. Therefore, the COUNTY and CITY agree to the following 1. The COUNTY and the CITY renew the Agreement for the COUNTY's 2011 Fiscal Year with the Agreement to expire September 30, 2011 or the completion of the Project as determined by the COUNTY, whichever occurs sooner. 2. The COUNTY and CITY agree to the revised payment schedules. 3. All terms and conditions of the original Agreement as amended remain in effect except to the extent modified by this Renewal. COUNCIL ACTION: Approved on 9/28/2010 DATE: Tuesday, September 28, 2010 REFERENCE NO.: C-24495 LOG NAME: 20DIRKS ROAD -TARRANT COUNTY INTERLOCAL RENEWAL SUBJECT: Authorize the Annual Renewal of City Secretary Contract No. 40108, an Interlocal Agreement with Tarrant County in the Amount of $2,000,000.00 for Participation in the Construction of Dirks Road from Bryant Irvin Road to the Western Limit of the Future Southwest Parkway (COUNCIL DISTRICT 3) RECOMMENDATION: It is recommended that the City Council authorize the City Manager to renew City Secretary Contract No. 40108, an Interlocal Agreement with Tarrant County in the amount of $2,000,000.00 for the construction of Dirks Road from Bryant Irvin Road to the western limit of the future Southwest Parkway. DISCUSSION: On January 9, 2007, (M&C G-15571) the City Council authorized the sale of $42,325,000.00 Certificates of Obligation for the purpose of funding part of the Critical Capital Needs Program. That amount included $7,500,000.00 for the design and construction of Dirks Road from Bryant Irvin Road to Granbury Road. Dirks Road will be reconstructed as a six lane divided principal arterial roadway with traffic signal, storm drainage, and sidewalk improvements. The construction of Dirks Road has been separated into two phases. The first phase is from Bryant Irvin Road to the western limit of the future Southwest Parkway. The second phase is from the eastern limit of the future Southwest Parkway to Granbury Road. City Council authorized the execution of City Secretary Contract No. 40108, an Interlocal Agreement with Tarrant County for participation in the construction of Phase 1 of Dirks Road from Bryant Irvin Road to the western limit of the future Southwest Parkway, via M&C C-24142 on March 23, 2010. The renewal of this Interlocal Agreement is required once a year for the County's participation in the new fiscal year. Under this Agreement, Tarrant County will reimburse the City up to $2,000,000.00. The City will provide all project management, inspection, and material testing necessary for the project. This project is located in COUNCIL DISTRICT 3, Mapsco 1026 and 102C.
