SUBJECT: Lancaster Avenue Construction Status

This report is a follow-up to Informal Report JR) No. 8721 dated October 18, 2005. It provides
further update on the Lancaster Avenue construction delay.
The October 18 IR described the situation with the TXU distribution lines and the resulting suspension
of construction operations. On November I Council approved M & C No. C-21118 authorizing a
discretionary agreement with TXU for protection of its lines. The City manager's office has signed
and sent that agreement to TXU. They will hopefully start work early next month.
TxDOT has now received a change order proposal from the Lancaster Avenue construction contractor,
Ed Bell, for $227,414 for slower production rates and additional mobilizations required to perform
work in coordination with and around the TXU work. TxDOT considers this proposal to be
reasonable. The alternative would be to continue the suspension until February when TXU is
scheduled to finish its work. Ed Bell has indicated that if the suspension extends to them they will
submit a claim for approximately the same $200,000+ for extended overhead and other costs associated
with the delay. In either case the cost would be totally the City's because it would be due to a utilities
conflict, and the City is responsible for all utility clearances.
Staff thinks the better alternative is to accept the current proposal and gain approximately two months
on the project schedule. Therefore, staff is processing payment to TxDOT at this time.
The Local Transportation Advance Funding Agreement with TxDOT that was approved in 2002 under
M & C No. C -18962 includes an estimated $2,889,000 as the City's share for construction of the
project. The current estimate to complete is $1,350,000 including the recently approved TXU
agreement and the proposed change order.
