HomeMy WebLinkAboutContract 39559THE STATE OF TEXAS COUNTY OF TARRANT � �RETTA�R� 5 KNOW ALL BY THESE PRESENTS INTERLOCAL AGREEMENT This Agreement is made and entered into this ?i'� ay of �ii (✓ , 2009, by and between the County of Tarrant, acting herein by and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY, and the City of Fort Worth, hereinafter referred to as CITY, both of Tarrant County, State of Texas, witnesseth: WHEREAS, this Agreement is made under the authority of Sections 791.001- 791-029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body fmds that the performance of this Agreement is in the common interest of both parties, that the undertaking will benefit the public and that the division of costs fairly compensates the performing party for the services or functions under this agreement; and WHEREAS, each governing body agrees to share in the cost of the services described below. NOW THEREFORE, the COUNTY and CITY agree as follows: 1. COUNTY agrees to furnish all labor necessary to provide six inches (6") of base stabilization and four inches (4") of HMAC on the Greenbriar Recreation Center entrance road postured in the City of Fort Worth, Texas. Total Square Footage 40,100 square feet 2. CITY agrees to furnish all necessary materials to accomplish the task and pay all trucking charges, however, the cost of materials and truclang charges are approximately $61,306.00. OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX 3. CITY will furnish a site for dumping waste materials that are generated from this project. 4. CITY agrees to furnish all necessary rights of way and plan specifications and engineering drawings. 5. CITY agrees to furnish all necessary traffic controls, i.e. Type A barricades to redirect traffic flow to alternate traffic lanes during the construction phase, if required. 6. CITY will pay the COUNTY a flat rate cost of One Hundred Dollars and 00/100 ($100.00) for equipment and labor to accomplish the project. 7. CITY agrees to furnish all temporary lane markings to delineate driving lanes upon completion of project until proper marking can be applied to the roadway. COUNTY may apply permanent striping, if necessary, upon request by the CITY. COUNTY reserves the right to inspect and approve all materials used in this project. person. Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other than claims for which liability maybe imposed by the Texas Tort claims Act. 10. Nothing in the performance of this Agreement shall impose any liability for the claims against CITY other than claims for which liability maybe imposed by the Texas Tort claims Act. 11. If engineering services and/or storm water run-off plans are required for the Project, CITY shall provide and pay for such services. CITY shall notify COUNTY within thirty (30) days of completion of the Project of any complaint which the CITY may have regarding same. Upon completion of the Project, CITY shall be responsible for maintenance of same. 12. The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement. CITY agrees that COUNTY is relying upon CITY for notice to proceed with this Project, but COUNTY shall not be required to perform this Agreement within any time limit. 13. By entering into this Agreement, the parties do not intend to create any obligations expressed or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. 14. Nothing contained in this Agreement is intended by the parties to create a partnership or joint venture between the parties, and any implication to the contrary is hereby expressly disavowed. It is understood and agreed that this Agreement does not create a joint enterprise, nor does it appoint any party as an agent of any other party, for any purpose whatsoever. 15. This agreement becomes effective when signed by the last party whose signing makes the agreement fully executed and remains in force and effect until the completion and acceptance of the Project unless otherwise terminated. TYPE: **C-23809 LOG NAME: CONSENT PUBLIC HEARING. 80GREENBRIAR ACCESS RD_INTERLOCAL m SUBJECT: Authorize an Interlocal Agreement with Tarrant County for Reconstruction of the Greenbriar Community Center Access Road with City Participation in an Amount Up to $61,306.00 RECOMMENDATION: It is recommended that the City Council authorize the City Manager to enter into an Interlocal Agreement with Tarrant County for the reconstruction of the existing park access road from Hemphill Avenue to Greenbriar Community Center Access Road with City participation in an amount up to $61,3069000 DISCUSSION: The purpose of this M&C is to authorize the City Manager to enter into an Interlocal Agreement with Tarrant County to reconstruct the Greenbriar Community Center access road. On October 28, 2008, (M&C C-23146) the City Council authorized the City Manager to award a contract to Dirtco, LP, d/b/a Styles Contracting, in the amount of $295,250.00 for parking lot improvements at Greenbriar Community Center Access Road. The bid alternate amount of $140,475.00 for roadway reconstruction was not accepted due to lack of funds. In November 2008, the Parks and Community Services (PACs) Department approached Tarrant County requesting the use of the County work force to reconstruct the access road. The County was favorable to the proposal and agreed to enter into an Interlocal Agreement to pursue the work upon completion of the parking lot improvement project, which was completed in February 2009. In April 2009, .the County provided a project cost to the City in the amount of $61,306.00 for roadway reconstruction. The work will consist of pulverizing the existing asphalt roadbed for use as roadway base material, cement stabilization of the pulverized asphalt base material and installation of four inch asphalt roadway surface course. On April 21, 2009, the Tarrant County Commissioners Court passed Court Order No. 105416, authorizing the County to enter into an Interlocal Agreement with the City of Fort Worth for reconstruction of the access road. Greenbriar Community Center is located in COUNCIL DISTRICT 9.
