THIRD AMENDMENT TO CITY SECTRETAKY CONTRACT N0. 39596
WHEREAS on December 14, 2009, the City of Fort Worth ("City") and Salvation
Army ("Contractor") made and entered into City Secretary Contract No. 39596 (as
amended, the "Contract");
WHEREAS, the Contract provided funding to Contractor pursuant to a grant
received by City from the United States Department of Housing and Urban Development
("HUD") under Title XII of the American Recovery and Reinvestment Act of 2009,
("Recovery Act") for utilization in connection with its Homelessness Prevention and
Rapid Re -Housing Program ("HPRP");
WHEREAS, the first amendment of the Contract reallocated Sixty Four Thousand
Nine Hundred Thirty Eight Dollars and Forty Seven Cents ($64,938.47) of HPRP funds
within eligible cost items but leaving the total grant award at One Hundred Eighty
Thousand Five Hundred Sixty Four Dollars and Ninety -Nine Cents ($180,564.99);
WHEREAS, the second amendment of the Contract extended the Term until
March 31, 2012 as authorized by M&C C-23715; and
WHEREAS, City and Contractor desire to further amend provisions in the
Contract to add an additional $60,000.00 for Contractor to provide additional services;
NOW, THEREFORE, City and Contractor hereby agree:
I.
The term of the Contract is hereby extended to July 15, 2012. All reimbursement requests
must be received by Contractor by July 31, 2012.
II.
Section 2 Compensation and Method of Payment" subsection (a) is hereby deleted and
replaced with the following:
"City will disburse HPRP funds in an amount up to TWO HUNDRED FORTY
THOUSAND, FIVE HUNDRED AND SIXTY-FOUR 99/100 to Contractor on a
reimbursement of expenses basis. Contractor is acting as a subrecipeint for the purposes
of this contract in carrying out the eligible activities as set forth in Exhibit A- Scope of
Services."
III.
Exhibit D —Program Operating Budget is replaced in its entirety with the revised Exhibit
D attached hereto.
IV.
All terms amended herein shall be effective as of September 1, 2009. All other terms and
conditions of the Contract not amended herein remain unaffected and in full force and
effect, are binding on the Parties and are hereby ratified by the Parties. Terms used but
not defined have the same meaning as the Contract.

THE SALVATION ARMY POLICY STATEMENT
ON RELATIONSHIPS WITH OTHER GROUPS AND ORGANIZATIONS
The Salvation Army in th.e United States works cooperatively with many groups --
governmental, social service, civic, religious, business, humanitarian, educational,
health, character building, and other groups -- in the pursuit of its mission to preach the
Christian Gospel and meet human need.
Any agency, governmental or private, which enters Into a contractual or cooperative
relationship with The Salvation Army should be advised that;
1. The Salvation Army is an international religious and charitable movement organized
on a quasi -military/ pattern and is a branch of the Christian church.
2. All programs of The Salvation Army are administered by Salvation Army Officers
who are ministers of the Gospel.
3. The mofiivation of the organization is love of God and a practical concern for the
needs of humanity.
4. The Salvation Army's provision of food, shelter, health services, counseling, and
other physical, social, emotional, psychological and spiritual aid, is given to persons
in need simply because they are in need, regardless of race, color, religion, sex, age,
national origin or handicap.
Organizations contracting andJor cooperating with The Salvation Army maybe assured
that because The Salvation Army is rooted in Christian compassion and is governed by
Judeo-Christian ethics, the provisions of its contracts and agreements will be strictly
observed.

Authorize Substantial Amendment to the City's 2008-2009 Action Plan, Authorize Change in Use and
Expenditure in the Amount Up to $300,000.00 in Homelessness Prevention and Rapid Rehousing
Funds, Authorize Execution of Contract Amendments with Cornerstone Assistance Network, The
Salvation Army and the Fort Worth Housing Authority to Award Funds, Extend the Term and to Increase
Funding (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the Substantial Amendment to the City's 2008-2009 Action Plan regarding the change in
use in an amount up to $300,000.00 in funds for the Homelessness Prevention and Rapid Rehousing
Program;
2. Authorize the execution of a contract amendment with Cornerstone Assistance Network to increase
Homelessness Prevention and Rapid Rehousing Program funding in an amount up to $100,000.00
from remaining Homelessness Prevention and Rapid Rehousing Program funds;
3. Authorize the execution of a contract amendment with The Salvation Army to increase funding in an
amount up to $100,000.00 from remaining Homelessness Prevention and Rapid Rehousing Program
funds;
4. Authorize the execution of a contract for a one year term with the Fort Worth Housing Authority in
an amount up to $100,000.00 from remaining Homelessness Prevention and Rapid Rehousing

Program funds; and
5. Authorize the amendment of contracts, if necessary, to achieve program goals provided that the
amendment is within the scope of the program and in compliance with applicable laws and regulations
governing the use of federal grant funds.
DISCUSSION:
On April 18, 2009, the City of Fort Worth (City) issued requests for proposals from local agencies to
administer Homelessness Prevention and Rapid Rehousing (HPRP) activities to benefit low income
City residents. On August 18, 2009, (M&C C-23715) the City Council authorized contracts to
administer HPRP programs. The Contracts were for a term beginning September 1, 2009 and ending
August 31, 2011. On December 13, 2011, (M&C C-25345) the City Council authorized amendments
to contracts with Cornerstone Assistance Network, the Community Enrichment Center and SafeHaven
of Tarrant County to increase funding and extend their contracts.
The City currently has HPRP funds available that have been repaid to the City for ineligible costs. The
City must expend these remaining HPRP funds by July 21, 2012. In order to meet the United States
Department of Housing and Urban Development (HUD) deadline, agencies that are willing and have
the capacity to expend the funds will need to either enter into a new contract with the City or extend
and amend their existing HPRP contract. Staff recommends that the City Council approve the
expenditure in an amount up to $300,000.00 in HPRP funds as shown below:

A public comment period concerning the change in use of these funds was held from March 11, 2012
to April 11, 2012. Any comments are maintained by the Housing and Economic Development
Department in accordance with federal regulations.
This program benefits ALL COUNCIL DISTRICTS.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget, as appropriated, of the Grants Fund.
