On August 36, 2009, the Citmy off FortgWorth ("City") and John Dennis ("Conservator") entered into City
Secretary Contract No. 30 \ \Q 1 ("Contract"). The City has designated the Arts Council of Fort
Worth and Tarrant County, Inc. as its Contract Manager to manage this agreement on its behalf.
SERVICES
1.1 Conservator covenants and agrees to fully provide, or cause to be provided, with good
faith and due diligence, general maintenance and conservation services ("Services") at the direction of
the Contract Manager and in accordance with annual addenda corresponding to the FWPA workplan
which shall be executed to this agreement and incorporated herein for all purposes.
1.2 Services are to be performed in compliance with the AIC Code of Ethics and Guidelines
for Practice.
1.3 Existing conditions hidden or concealed and not available for reasonable visual
observation discovered during Services will be reported promptly to Manager prior to commencing
further Services.
1.4 Conservator shall promptly repair, to a condition reasonably acceptable to the Manager
and the City, any damage caused to city property by Conservator or its employees, agents or
subcontractors.

Authorize a Professional Services Agreement in an Amount Not to Exceed $105,000.00 with John R.
Dennis for Conservation Maintenance and Treatment of Various Artworks in the Fort Worth Public Art
Collection
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to enter into anon -exclusive, three
year professional services agreement in an amount not to exceed $105,000.00, with objects conservator
John R. Dennis for maintenance and conservation treatment of various artworks in the Fort Worth Public
Art Collection.
DISCUSSION:
The three year Professional Services Agreement will enable the City to implement its Public Art Collection
Management/Conservation program in order to care for and maintain the City's Public Art collection as set
forth in the Long Range Public Art Plan for the Water Fund adopted by City Council on May 9, 2006. The
Agreement will be in an amount not to exceed $105,000.00 for the duration of the term of the Agreement,
using funds from the annual Public Art Conservation Fund — Operating Budget.
The Fiscal Year 2008-2009 Work Plan (M&C C-23101) adopted by City Council on September 20, 2008,
outlines the Collection Management plan for the first year of this Agreement. Subsequent annual
Conservation Workplans, recommended by the Fort Worth Art Commission and approved by Council as
part of the annual workplan, will be issued to the Conservator and added as addendum to his contract.
BACKGROUND:
The City owns 55 artworks accessioned into the Fort Worth Public Art collection and sited on City -owned
property. During the term of this Agreement, the collection is expected to increase by 60 percent to 89
artworks sited in all districts of the City. The collection is comprised of works including stand-alone
sculptures, painted and tile murals, architecturally integrated enhancements and artist -created historic
monuments.
On February 25, 2009, Fort Worth Public Art issued a Request for Qualifications (RFQ) for general
conservation services for the purposes of creating apre-qualified pool of qualified conservators with
various media specialties. The RFQ was sent to individuals and firms, posted on the FWPA and CFW
websites, published in the Fort Worth Star Telegram (3.5.09 — 3.19.09) and posted on the National Public
Art Network Listserve. Services to be performed under this agreement include, but are not limited to:
. Condition assessments;
. General cleaning;
. Conservation treatment and repair;
. Treatment documentation (written and photographic); and
. Maintenance planning.
Respondents were asked to provide materials that demonstrate ability to accomplish the work (firm
history, team credentials and related experience), philosophical treatment approach, evidence of

insurability and narrative of expenses including hourly treatment, administrative and per diem
rates. Applicants were evaluated based on media of specialization and were not expected to exhibit
expertise in all media and materials.
Nine candidates submitted material for review. Each submission was reviewed by a review panel
consisting of three staff members and one Art Commissioner, a process recommended by the City of Fort
Worth Purchasing Department.

Jennifer Conn, Public Art Collection Manager; and
Steve Kline, Art Commissioner, General Services Administration and AIA Fort Worth.
A scoring matrix considering ten factors was created to rank qualifications and ability and to quantify
feasibility and rate structures.
The panel selected John Dennis as a qualified candidate to provide conservation service.
The City's overall M/WBE goal for the Fort Worth Public Art Program is 25 percent of total capital project
dollars expended on public art annually.
Over the course of the term of this Agreement, Artworks is located in ALL COUNCIL DISTRICTS
throughout the City will benefit.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget, as appropriated, of the General Fund.
