The Lease was for an initial term of one year, beginning on November 1, 2009 and ending on October 31, 2010. Section 3 of the Lease allows for two (2) successive options to renew the Lease, each for a one (1) year term. Per Section 3, exercise of any such option requires written notice by Tenant to Landlord 30 days prior to the expiration of the previous term. Tenant did not provide the required notice prior to October 31, 2010, but wishes to exercise the first renewal option. By execution of this letter agreement, Landlord agrees to waive the notice requirement contained in Section 3 of the Lease, and the parties agree that the Lease's first renewal term will begin on November 1, 2010 and will end on October 31, 2011.
