AMENDMENT NO. 1

WHEREAS, the City of Fort Worth (City) and Graham Associates,
Inc., (Engineer) made and entered into City Secretary Contract No.
39764, (the Contract) which was authorized by the City Council by
M&C C-24032 on the 26th day of January 2010, and
WHEREAS, the Contract involves engineering services for the
following project:
Hulen Street from McPherson Blvd. to West Cleburne Road, Project
No. #01365
WHEREAS, it has become necessary to execute Amendment No. 1
to said Contract to include an increased scope of work and revised
maximum fee,
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated September 6, 2011, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $28,100.00.
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $209,508.00.

3.
A11 other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Buckley:
PART 1: CHANGES TO THE PAVING AND DRAINAGE
Graham Associates, Inc. revised the construction plans to replace the buttons as shown in
the standard details to thermoplastic pavement markings. This change revised 5 sheets of
plans and 4 standard details.
Graham Associates,revised the location of the street lights in order to accommodate
the water line. This change revised 4 sheets of plans.
Graham Associates,revised the plans to include special joint layout sheets. Thus
addition added 2 sheets of consttuctian plans.
PART 2: SPECIFICATIONS AND PLAN SUBMITTAL
Graham Associates, Inc. made additional changes to the specifications, quantities, and
plans to review comments after the final plans were submitted to the city. New
quantities, page numbers and re -plotting of the construction plans were required.
PART 3; RIGHT-OF-WAY
Graham Associates, Inc. did not include right of way in the original scope. All right of
way was thought to be acquired for the project. The plans now require 9 right of way
parcels including exhibits and legal descriptions, and 4 right of way plan sheets to acquire
right of way.

PART 4: CHANGES TO THE WATER IMPROVEMENTS
Criado & Associates, Inc. made changes to the water line plans revising the aligninent
oMet from the centerline. This alignment offset was changed originally because of the
location of the street lights and foundation locations. John Kasavich made changes which
changed the aligninent of the line and effecting most of the water line sheets. This
change revised 7 sheets of plans.
COMPENSATION
Graham Associates, Inc. was askuig for total compensation of items 1,2,3,&4 above for
the sum of $22,450.00.
Criado &Associates, Inc was asking for total compensation of $5,650.00 for item 4.
Graham Associates, Inc. and the City of Ft Worth have worked together to complete and
bid thus project on schedule. We are asking you to consider this proposal for our extra
work of $28,100.00, and we look forward to working with the city staff on the next
project. With this amendment the contract still has a minimum of 20% M/WBE.

Authorize the Execution of an Engineering Services Agreement in the Amount of $181,408.00 with Graham
Associates, Inc., for the Design of Hulen Street from McPherson Boulevard to West Cleburne Road and
Adopt Appropriation Ordinance (COUNCIL DISTRICT 6)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by
$258,000.00 in the TPW Gas Well Revenues Fund from available funds; and
2. Authorize the City Manager to execute an Engineering Services Agreement in the amount of
$181,408.00 with Graham Associates, Inc., for the design of Hulen Street from McPherson Boulevard to
West Cleburne Road.
DISCUSSION:
The scope of services for this Engineering Agreement includes design of one-half of the paving plus all of
the required storm drain and water line improvements along Hulen Street as a new arterial roadway from
McPherson Boulevard to West Cleburne Road. Only one-half of the planned four lane arterial will be built
right now.
Graham Associates, Inc., has proposed to complete the final design plans and specifications for a lump
sum fee of $181,408.00. City staff considers this fee to be fair and reasonable for the scope of services to
be performed. Funding for this project would come from undesignated gas well revenues.
Graham Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to 20 percent
MWBE participation. The City's goal on this project is 20 percent.
This project is located in COUNCIL DISTRICT 6, Mapsco 103W and 117A.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the current capital budget,
as appropriated, of the TPW Gas Well Revenues Fund.
