ENCROACHMENT AGREEMENT
This AMENDMENT TO CITY SECRETARY CONTRACT NO. 396499
ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OF
FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and
through its duly authorized City Manager or duly designated Assistant City Manager, hereinafter
referred to as the "City," and TARRANT COUNTY, acting herein by and through its duly
authorized representative hereinafter referred to as "Tarrant County".
RECITALS
WHEREAS, the City of Fort Worth ("City") and Tarrant County made and entered into
City Secretary Contract No. 39649 (the "Agreement") authorized by City Council by M&C C-
23968 on December 15, 2009 to authorize the use of public right of way for the construction of
various improvements to be located at Burnett Street, Weatherford Street, Cherry Street and
Belknap Street; and
WHEREAS, the Agreement contains a list of the various improvements and exhibits that
depict the construction of the various improvements; and
WHEREAS, it advisable to execute this Amendment to the Agreement to revise the
exhibits in the Agreement to add site walls and a trash receptacles to the description of
improvements and exhibits of the improvements encroaching in to the public right of way.
NOW THEREFORE, City and Tarrant County, acting herein by and through their duly
authorized representatives, enter into the following that amends the Agreement:
1.
Section 1 is hereby amended to add site walls and trash receptacles to the list of
improvements listed and hereby added to Exhibit A is Exhibit Arl attached hereto and incorporated
herein to the Agreement.

All other provisions of the Agreement which are not expressly amended herein shall remain
in full force and effect.
