WHEREAS, The City of Fort Worth and Arthur Weinman Architects (Architect) made and entered into City
Secretary Contract No. 40218 (The Contract); and
WHEREAS, further amendment is necessary for additional design services to increase the scope of work
for the redesign of an existing kitchen; and
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
1.
Article 1.1, SECTION I —SERVICES OF THE ARCHITECT, a paragraph is added to read as follows:
"Provide additional design services for increasing the Architect's proposed scope of work due to
the Owner's request to upgrade an existing kitchen. The cost of this additional service is
$2,000.00 plus up to $500.00 in reimbursable expenses. The scope of services is described
more fully in the Arthur Weinman Architects' letter dated January 4, 2012 subject: R.D. Evans
Community Center, which is attached hereto and as Attachment "A" and made a part of this
Agreement."

Paragraph 1 of SECTION V -COMPENSATION TO ARCHITECT, is amended as follows:
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a At; fee of
$32,790.00 plus up to $2,500,00 in reimbursable expenses."

All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

the rehabilitation of the R.D. Evans Recreation Center at 3242 Lackland Road, Fort
Worth, Texas. Our proposed additional services shall include design and construction
documents for new cabinets and counter in the existing kitchen.
New cabinets and counters shall be designed in accordance with Texas accessibility
requirements. Design shall include new base cabinets according to City standards;
stainless steel counter top with integral sink, backsplash and marine edge; and all new
upper cabinets according to City standards. We shall specify new faucet set for the
integral sink per City standards, and new range according to City standards (if
applicable). New range and other residential type kitchen equipment shall be supplied
and installed by others and are outside the scope of our project.
Architectural services will not include the consulting services of a Structural Engineer or
MEP Engineer. All new cabinets and fixtures will be designed to align with and connect
with existing utility services wherever possible. Architectural services shall include up to
two design meetings with yourself, your staff or the client's staff either at your offices, our
office, or t h nroject site. Any additional design meetings wo�111d be additional to this
proposal and would be charged at our hourly rates.
Once design or construction documents have been approved by you or your associates,
subsequent revisions or additions would be an addition to this proposal and charged on
the basis of our hourly rates.
Our services shall include preparation of documents for presentation by the Contractor
for City of Fort Worth building permit. Our services do not include permit application
services. If requested the Architect will provide telephone advice and assistance during
bidding, and if requested will check shop drawings and required submissions for the
of the building covered by our services.
Please call us during construction if there are any questions regarding this project.
Should you or your representatives or the Owner choose not fo involve the Architect
during the construction phase of the project, the Architect will not have any liability for
the construction phase of the project. Without timely notification of questions of
interpretation of the construction documents or timely notification of any problems during

for problems encountered during construction.
The services of the Architect or the Architect's consultants for construction observation
and verification of the progress of work in the f1e1d during the construction period are ,not
included in this proposal. Should these services be required they would be an addition to
this proposal and charged at our hourly rates.
Any services for revision of the documents to meet Owner's revised requirements after
final design approval would be an addition to this proposal and charged at our hourly
rates.
When the construction documents are complete submission is required for approval to
the Texas Department of Licensing and Regulation for compliance with the Texas
Architectural Standards Act. Documents will be submitted by the Architect's office. All
fees are the responsibility of the Owner, and will be paid directly by the Owner or by the
Owner's check via the Architect with submissions. All construction must be in

Regulation for compliance, usually within one year of construction. The Owner or
Owner's Representative shall be responsible for notifying the reviewer when
construction is complete, scheduling the date and time of the review, and payment of all
associated fees These services arenot included as part of this proposal. Any services
for revision of the documents for requirements subsequent to our services, including
time for review and negotiations with the T xDL&R, would be an addition to this proposal
and charged at our hourly rates.

Any Cify, State or Federal fees for permits, fees, licenses, drawing reviews, site inspections, and so forth,
including Texas Accessibility Standards compliance, are the responsibility of the Owner, and will be paid
directly by the Owner or by the Owner's check via the Architect with submissions.

The Architect or the Architect'& cons) ultents are in no way respo; rsible for any asbestos or hazardous
materials detection or removal. We will clearly assign asbestos and heavy metals or hazardous materials
detection and removal to the General Contractor in the Construction Documents.
It is specifically understood and agreed that when a lump sum fee is quoted, the fee covers the performance
of corresponding services only one time after authorization to proceed with the work. Once approval of the

We shall not be responsible for any delay in services caused by circumstances beyond our reasonable
control, nor delay, which may be occasioned by actions which, in the sole judgment of the Architect, are
required in the exercise of usual and customary professional care. The Architect and his consultants shall
not be liable for damages arising out of any such delay, nor deemed to be in default as a result thereof.

project have the correct experience and skills to complete the work in a complete and craftsman -like

The standard of care for all professional services performed or furnished by the Consultant (Arthur
