HomeMy WebLinkAboutContract 40217CITY SECRET Iffm i" to WU a\. • a - CROSSING REHABILITATION AGREEMENT THIS AGREEMENT, made this 29th day of April, 2010 by and between FORT WORTH &WESTERN RAILROAD, ('Railroad"), and the CITY OF FORT WORTH of the state of TEXAS, ("the City"), WITNESSETH, RECITALS: The City has requested that the Railroad improve the existing crossing at East Berry Street (DOT# 7976775) to which the Railroad is agreeable, but solely upon the terms and conditions hereinafter set forth. AGREEMENT: NOW THEREFORE, in consideration of the premises and of the promises and conditions set forth in this agreement, the parties hereto agree as follows: 1. The Railroad shall, subject to the reimbursement provided for in this agreement, furnish all labor, materials, equipment and supervision for crossing rehabilitation including the installation of concrete panels at the above location. 2. The City agrees to pay the entire cost of all materials which shall be payable upon Railroad notification to the City that the project is complete. The City also agrees to provide necessary traffic control or temporary road closure and detour and any needed approach pavement. The City 's participation is limited to $34,132.55. Costs in excess of $34,132.55, if any, will require additional City authorization before payment can be made. 3. Trac-Work, Inc. proposes to famish all equipment, labor, supervision, flagman, line locates, materials and insurance necessary to perform the following non-taxable road crossing replacement on East Berry Street in Fort Worth, Texas. BID # 1-replace crossing Trac-Work, Inc. proposes to replace the existing crossing with a 99 foot new Century Precast Concrete Crossing, 97 wide panels with rubber inserts using 7"x 9"x 9' ties. TWI will excavate the old track and ballast down 8" below the bottoms of the ties, install filter fabric and new track ballast. Then construct the new track back using # I relay 112 lb or heavier rails, new ties, spikes, bolts and washers. The track will be raised and tamped up to proper elevation using an on -rail tamper. TWI will weld all joints in the crossing. TWI will install hot mix asphalt provided by the city of Ft. Worth at a profile determined by the city at the time of construction. TWI will stockpile any excavated materials on site or load them in a truck or dumpster if they are provided at the time of construction.
