HomeMy WebLinkAboutOrdinance 5946ORDINANCE NO, AN ORDINANCE PROVIDING THAT A PORTION OF HOLTZER DRIVE BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described portion of Holtzer Drive be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever: BEGINNING at a point on the East line of the W. D. Conner Survey 202.93 feet South of the Northeast corner of the Baker Floral Company 10-acre tract as described in Vol. 832, page 423, of the Deed Records of Tarrant County, Texas, said point being on the West right of way line of University Drive; THENCE South along the East line of said W. D. Conner Survey and the West right of way line of said University Drive a distance of 47.50 feet to a point on the new North line of Holtzer Drive as shown on file No. 13-H-39 on record in the Engineering Division, Public Works Department of the City of Fort Worth, Tarrant County, Texas; THENCE South 57 degrees 22 minutes West along the new North line of said Holtzer Drive a dis- tance of 285.86 feet to the beginning of a curve to the right having a radius of 710.0 feet and whose center bears North 32 degrees 38 minutes West; THENCE in a Southwesterly direction along the arc of said curve to the right through a central angle of 25 degrees 00 minutes a distance of 309.79 feet to the point of tangency of said curve; THENCE south 82 degrees '22 minutes West a distance of 27.97 feet to a point; THENCE North 1 degree 13 minutes West a distance of 40.25 feet to a point an the South line of said Baker Floral company Tract, said point being the Southeast corner of a tract of land conveyed to M. T. Robinson as recorded in Vol. 3460, page 649 of said Deed Records; THENCE North 82 degrees 22 minutes East a distance of 164.6 feet to a point; THENCE North 57 degrees 22 minutes East a distance of 460.0 feet to the place of beginning, and con- taining 23,137.08 square feet of land. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. L. Baker, Jr., owner of Tract 3, W. D. Conner Survey No. 288, has requested the City to vacate a portion of Holtzer Drive which adjoins his property, as OWEN HARDY shown on the attached plat. This request is made to permit the right-of-way REED HIGHTOV SR to be incorporated into the lot owned by E. L. Baker, Jr. The original dedication for this section of Holtzer Drive was made subject to any unused portion being returned to the property owner upon request. Follow- ing this request, City departments reviewed the right-of-way requirements for Holtzer Drive and determined that a surplus of right-of-way does exist at the site in question. The excess right-of-way will not be necessary for the proper development of .this street. This section of Holtzer Drive is open but is not paved or guttered. City departments and private utility companies have reviewed this request and have voiced no objection to this vacation, provided the applicant plats the vacated right-of-way with adjoining property, dedicates five feet of right- of-way for the widening of Collinsworth Street, and reserves the vacated right-of-way as an easement for existing utilities. The City Plan Commission has reviewed the proposed vacation and recommends adoption of an ordinance vacating the right-of-way as requested, ted, subject to the applicant's platting the vacated right-of-way with the adjoining pro- perty, dedicating 5 feet of right-of-way for the widening of Collinsworth Street, and retaining the vacated right-of-way as an easement. A plat has been filed with the Planning Department reserving the necessary easements and dedicating 5 feet of right-of-way for Collinsworth Street.
